[Amended 6-22-1982 by L.L. No. 9-1982; 3-16-2010 by L.L. No. 1-2010]
It is the intent of this chapter to prescribe regulations, consistent with nationally recognized good practice, for the safeguarding, to a reasonable degree, of life and property from the hazards of fire and explosion arising from the storage, handling and use of hazardous substances, materials and devices and from conditions hazardous to life or property in the use or occupancy of buildings or premises. The National Fire Protection Association shall be deemed to be prima facie evidence of compliance with this intent, except where this chapter is stricter.
[Amended 6-22-1982 by L.L. No. 9-1982; 3-16-2010 by L.L. No. 1-2010]
All matters within the intent of this chapter covered in detail by this chapter shall comply with nationally recognized good practice. The National Fire Protection Association shall be deemed to be prima facie evidence of compliance with nationally recognized good practice.
[Amended 12-31-1996 by L.L. No. 18-1996]
A.
The provisions of this chapter shall apply equally to new and existing conditions, except that existing conditions not in strict compliance with the terms of this chapter may be permitted to continue where the exceptions do not constitute a distinct hazard to life or property. The Chief Fire Safety Inspector shall have the authority to grant a waiver of the existing condition upon the written application of the person owning the installation concerned.
B.
Any waiver of existing conditions shall be based upon the public safety being secured. The decision of the Chief Fire Safety Inspector shall be filed with the Town Clerk, and a true copy, signed by the Chief Fire Safety Inspector, shall be furnished the applicant.
[Added 1-23-1996 by L.L. No. 1-1996]
If any clause, sentence, paragraph, section or part of this chapter shall be adjudged by any court of competent jurisdiction to be invalid, each adjudication shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the controversy in which said judgment shall have been rendered.
