This chapter shall be known as the "Administrative Code" and is herein referred to as the "code." This code is adopted pursuant to the Mayor-Council Plan of the Optional Municipal Charter Law (N.J.S.A. 40:69A-1 et seq. referred to herein as "the Charter"), as amended and supplemented.
The Township of Brick shall be governed by an elected Municipal Council, an elected Mayor and by such other officers and employees as may be duly appointed pursuant to law.

The Township government shall be comprised of the following offices, departments and agencies:
A. 
Offices:
(1) 
Office of the Mayor.
(2) 
Office of the Township Council and Township Clerk.
B. 
Departments:
(1) 
Department of Administration, Finance and Public Affairs.
(2) 
Department of Law.
(3) 
Department of Public Works.
(4) 
Department of Recreation.
(5) 
Department of Public Safety.
C. 
Division of departments: the respective divisions, bureaus, boards and offices into which such departments are divided pursuant to this chapter or other ordinances of the Township.
D. 
Agencies: the various judicial, legislative, advisory and independent agencies of local government provided pursuant to the Charter, general law, the Code of the Township of Brick or other ordinances of the Township.
The head of each department shall be qualified by experience and training to perform the duties of the office and shall, subject to the Charter and ordinances of this Township:
A. 
Have, exercise and discharge the functions, powers and duties of the department.
B. 
Prescribe the internal organization of the department and the duties of subordinates and assistants.
C. 
Administer the work of the department through the divisions established by ordinance and such other units of administration as the department head may find necessary or desirable.
D. 
Appoint officers and employees to be employed within the department and assign functions, powers and duties to them. The ultimate responsibility for the department shall remain with the director of said department.
E. 
Delegate such powers as the department head may deem necessary for the efficient administration of the department to be exercised under direction and supervision by division or bureau heads.
F. 
Report to the Mayor and Council, in such form as shall be approved by the Business Administrator, when requested by the Mayor, Council or Business Administrator.
No rule or regulation made by any department, officer, agency or authority of the Township within the jurisdiction of the Mayor shall, except upon written approval of the Mayor, take effect until at least 10 days after it is filed with the Township Clerk, as required by the Charter. This limitation of time shall not apply, however, to any order, rule or regulation which relates solely to the organization or internal management of the Township government or a part thereof.
Whenever a vacancy exists in the office of head of any departmental division by resignation, removal or otherwise, the director of such department is authorized to fill such vacancy temporarily, in cases not specifically provided for in the Charter or ordinances, by appointing an acting head of such departmental division, and by appointing officials within the department, wherever possible, who shall perform all the duties and functions of such departmental division head, pursuant to the provisions of the New Jersey statutes (civil service) until the office shall be filled permanently.
A. 
Notwithstanding any provision of this chapter to the contrary, whenever the head of any department or division is, by reason of absence or disability, unable to perform his or her official duties, the Mayor may, in writing, designate an individual to serve as the acting department or division head who shall perform the duties of such department or division head during such time as the absence or disability of the department or division head may continue.
B. 
When any person so designated to perform the duties of an officer during his or her absence or disability is required to sign any official document pertaining to such office, it shall be signed in the name of such officer and by the subordinate as designee.
All department and division heads, the Township Clerk and other management employees who are not members of collective bargaining units shall be entitled to the same vacation days, holidays, sick days, personal days, medical and insurance benefits, longevity benefits and other nonsalary benefits to which employees under their supervision are entitled under any collective bargaining agreement.
The holidays and vacations to which an employee is entitled shall be governed by any applicable collective bargaining agreement or other contract and the rules and regulations promulgated by the New Jersey Department of Personnel or other applicable law of the State of New Jersey.
The procedures and regulations regarding disciplinary actions taken against employees of the Township of Brick and the separation of employee-employer relations between employees of the Township of Brick and the municipality as employer shall be governed by any applicable collective bargaining agreement or other contract and the rules and regulations promulgated by the New Jersey Department of Personnel or other applicable law of the State of New Jersey.
Except as is otherwise provided by law or provided herein, all officers and employees appointed to positions of employment for the Township of Brick shall be, where practicable, bona fide residents of the Township of Brick at the time of appointment.
