The Mayor shall be the chief executive officer of the Township and shall have the power and duty to supervise the administration of the Charter (N.J.S.A. 40:69A-49 et seq.) and ordinances of the Township and all general laws applicable thereto.
The compensation of the Mayor of the Township shall be fixed by ordinance.
A.
The Mayor of the Township shall:
(1)
Have such powers of appointment and removal as are provided by law.
(2)
Have the power to appoint, with the advice and consent of Council, to all offices where no other provision is made for such appointment.
(3)
Assign or approve the assignment of space in public buildings and other public places for the temporary or permanent use of any department, body, officer, agency or instrumentality and shall, through the Business Administrator, control the assignment, allocation and use of furniture, equipment or other public property in the Township government.
B.
The Mayor, directly or through the Business Administrator, may assign and reassign, transfer and retransfer, either temporarily or permanently, any property or personnel from one function to another or from one administrative unit to another, as the efficient management of the Township government may require, subject to the express requirements of Title 4, New Jersey Department of Personnel, of the New Jersey Statutes, and all other applicable general laws.
C.
Nothing in this article shall apply to the offices of the Township Council and Township Clerk.
The Mayor may delegate to the head of any department any function, power or duty conferred upon the Mayor by ordinance which is not required by law to be performed or discharged personally by the Mayor. A copy of such change shall be in writing, and one copy shall be furnished to the President of the Council.
As provided by the Charter, the Mayor shall designate either the Business Administrator, an administrative department head or the Township Clerk to act as Mayor whenever the Mayor shall be prevented, by absence from the Township, disability or other cause, from attending to the duties of the office. During such time, the person so designated by the Mayor shall possess all the rights, powers and duties of Mayor. Whenever the Mayor shall have been unable for a period of more than 60 consecutive days, for any of the above-stated reasons, to perform his or her official duties, an Acting Mayor shall be appointed by a majority of all Council members (N.J.S.A. 40:69A-42). If the vacancy occurs subsequent to September 1 of the last year of the term of the Mayor whose office has become vacant, the office may be filled for its unexpired term by appointment by the governing body. If the vacancy occurs at any other time, the vacancy shall be filled for its unexpired term at the next general or regular municipal election, whichever occurs first, to be held not less than 60 days after the occurrence of the vacancy.
