Pursuant to Article 16, §§ 276 and 277 of the Town Law
of the State of New York and by resolution of the Town Board, the Planning
Board of the Town of Albion is authorized and empowered to approve plats showing
lots, blocks or sites, with or without streets or highways, within the incorporated
limits of the Town of Albion.
This chapter shall be known and may be cited as the "Subdivision Regulations
of the Town of Albion."
The subdivision of land shall conform with this chapter as well as with
appropriate laws, rules and regulations established by all governing bodies
having or claiming jurisdiction over various phases of the proposed development.
It is declared to be the policy of the Town of Albion to consider land subdivision
to be part of a process that provides for the orderly, efficient and economical
development of the Town in a manner that is reasonable and in the best interest
of the community. In its consideration of an application for the subdivision
of land, the Planning Board shall be guided by the following general requirements:
A. Land must be buildable and free of hazards. The physical
characteristics of the land to be subdivided shall be such that it can be
used for building purposes without danger to health and safety or peril from
fire, flood, erosion or other menace. Proper provision shall be made for vehicular
and pedestrian access, stormwater drainage, water supply and sewage disposal
as well as for other needed improvements.
B. Important community resources and natural features shall
be incorporated into the design of the subdivision as much as possible. To
the maximum practicable extent, existing features of the landscape such as
large trees, rock outcrops, water and flood courses, historic components and
other significant community assets shall be preserved.
C. Subdivisions shall be in conformance with all local legislative
requirements and consistent with the Comprehensive Plan, or as such Comprehensive
Plan document may be amended in the future.
