§ 1-1 Adoption of Code.

This Code, enacted hereby in the form of a local law in the form and manner prescribed by the Municipal Home Rule Law of the State of New York, is hereby adopted and enacted as the "Code of the Incorporated Village of the Branch" and shall be treated and considered as a new and original comprehensive Code which shall supersede all other local laws, ordinances, orders, rules and regulations hereinbefore passed or adopted by the Incorporated Village of the Branch prior to the enactment of this Code.

§ 1-2 Additions and amendments to Code.

Any and all additions or amendments to this Code, when passed in such form as to indicate the intention of the Board of Trustees of the Incorporated Village of the Branch to make the same a part hereof, shall be deemed to be incorporated in this Code so that reference to the "Code of the Incorporated Village of the Branch" shall be understood and intended to include such additions and amendments.

§ 1-3 Village Clerk to maintain office copy.

A copy of this Code shall be kept on file in the office of the Village Clerk of the Incorporated Village of the Branch, preserved in loose-leaf form or in such other form as the Village Clerk may consider most expedient. It shall be the express duty of the Village Clerk or someone authorized by him in writing to insert in their designated places all amendments, local laws, ordinances, orders, rules and regulations which indicate the intention of the Board of Trustees to make the same a part of this Code when the same have been printed or reprinted in page form, and to extract from this Code all provisions which may, from time to time, be repealed by said Board of Trustees. Said copy of this Code shall be available for examination during normal business hours to any person desiring to examine the same, and shall be considered the official Code of the Incorporated Village of the Branch.

§ 1-4 Unauthorized insertion or deletion of pages.

It shall be unlawful for any person, partnership, firm or corporation to change or amend by additions or deletions any part or portion of this Code, or to insert or delete pages or portions thereof, or to alter or tamper with this Code in any manner whatsoever which will cause the law of the Incorporated Village of the Branch to be misrepresented thereby.

§ 1-5 Violations and penalties.

In addition to any civil penalties or remedy specifically provided in any chapter of this Code for violation of any of the provisons thereof or for the abatement of the same, and except where a criminal or quasi-criminal penalty shall be specifically set forth in any chapter of this Code for violation of any of the provisions thereof, any person, partnership, firm or corporation who shall violate any of the provisions of this Code shall be guilty of a violation and shall, upon conviction by a court of competent jurisdiction, be sentenced to a term of imprisonment not to exceed 15 days and/or a fine not to exceed $250 in the manner prescribed by the Penal Law of the State of New York. Except to the extent otherwise prohibited by law, every fine and penalty imposed by any court of competent jurisdiction for the violation of any local law, ordinance, order, rule or regulation of the Incorporated Village of the Branch or any of its duly authorized agents or agencies, boards, commissions or other bodies shall be the property of the Incorporated Village of the Branch and paid to it in the manner prescribed by law.

§ 1-6 Provisions to supersede Village Law to the extent of conflict.

In accordance with the powers vested in the Incorporated Village of the Branch by Section 10 of the Municipal Home Rule Law of the State of New York, this Code and each of its chapters. Articles, sections, paragraphs, sentences, parts, clauses and other provisions hereof shall be deemed to amend and supersede the Village Law of the State of New York in the latter's application to the Incorporated Village of the Branch to the extent that this Code and each of its chapters, Articles, sections, paragraphs, sentences, parts, clauses and other provisions shall conflict with said provisions of the Village Law of the State of New York.

§ 1-7 Severability.

If any chapter, Article, section, paragraph, sentence, part, clause or provision of this Code shall be adjudged by any court of competent jurisdiction to be unconstitutional or otherwise invalid, said judgment shall not affect, impair or invalidate any other provision or the remainder of this Code but shall be confined in its operation to the chapter, Article, section, paragraph, sentence, part, clause or provision of this Code to which said judgment shall have been made specifically applicable by said court of competent jurisdiction.

§ 1-8 Effective date and repeal of other enactments.

All provisions of this Code shall be in full force and effect 30 days after adoption hereof by the Board of Trustees of the Incorporated Village of the Branch or upon the filing of three certified copies thereof in the office of the Secretary of State of the State of New York in the manner prescribed by Section 27 of the Municipal Home Rule Law of the State of New York, whichever shall last occur; and all local laws, ordinances, orders, rules and regulations of the Incorporated Village of the Branch hereinbefore passed or adopted and not contained or recognized and continued in full force and effect by reference herein are hereby repealed from and after the effective date of this Code.
