For the purpose of this article, the following terms shall have the meanings indicated:
CEMETERY and CEMETERIES
The Hillcrest Cemetery and the Oakland Cemetery, and the provisions of this article shall apply to both cemeteries.

The Town Manager shall have full charge and control of the cemeteries and shall generally exercise full and complete authority in all matters pertaining to the cemeteries, subject to such restraints as the Town Council may see proper to impose.[1]

The Town Manager, under the direction of the Cemetery Committee of the Town Council, shall superintend all improvements made in and upon cemeteries.

It shall be unlawful for any lot or grave site owner to sell or offer for sale, remove or attempt to remove any sound or living trees, plantings or sod used to beautify or preserve the cemeteries from a cemetery lot unless the removal of such trees, plantings or sod shall be necessary for the purpose of opening a grave site or shall be deemed necessary by the Town Council. Any person convicted for a violation of this section shall be subject to a fine of not more than $100.
It shall be unlawful for any person, except authorized Town personnel, to plant any trees, shrubbery, flowers or other growing vegetation in or on any section in the cemeteries. Any person convicted for a violation of this section shall be subject to a fine of not more than $100.

The Cemetery Committee of the Town Council shall have the power to establish and promulgate rules and regulations not in conflict with the provisions of this Code or other ordinances of the Town relative to the cemeteries. Such rules and regulations shall be subject to the approval of the Town Council. It shall be unlawful for any person to fail, neglect or refuse to comply with such rules and regulations so established, promulgated and approved. Any person convicted of a violation of this section shall be subject to a fine of not more than $100.
The purchase price of a lot, section or grave site in the cemeteries shall be paid to the Town Treasurer, who shall forthwith cause to be delivered to the purchaser of the lot in question an instrument signed by the Mayor and the Town Clerk.
Lots and grave sites in the cemeteries shall be sold only with provisions for perpetual care. Lots and grave sites in the cemeteries shall be sold at prices established by the Town Council.
No person shall inter, disinter or reinter a body within the cemeteries without first obtaining a permit to do so from the Town Office. No such permit shall be issued until the purchase price of the cemetery lot has been paid in full or arrangement has been made with the Town Office for such payment.
No person shall set or install any grave marker or footstone, tombstone or other stone in the cemeteries unless he shall first have secured a permit therefor from the Town Clerk.
Any person desiring a permit as required in § 60-13 shall file an application therefor with the Town Clerk. Such application shall indicate the location in the cemetery of the proposed grave marker or footstone, tombstone or other stone, shall contain a statement of its dimensions and specifications and shall set out such other information as may be required.

Upon the filing of an application, as provided in § 60-14, the Town Clerk shall, if he finds that the proposed grave marker or footstone, tombstone or other stone will be in compliance with this article, issue a permit for the setting or installation thereof. The payment of a fee as established by Town Council shall be prerequisite to the issuance of such permit.

Before starting any work towards the setting or installation of a grave marker or footstone, tombstone or other stone pursuant to a permit issued as provided in § 60-15, the holder of the permit shall give notice thereof to the General Superintendent, who shall inspect the grave marker or footstone, tombstone or other stone being installed and after installation is completed, for the purpose of ascertaining whether or not compliance has been had with the requirements of this chapter.

If, upon inspection made as provided in § 60-16, it shall be ascertained that the grave marker or footstone, tombstone or other stone in question has not been set or installed in accordance with this article, the General Superintendent shall order the requisite corrections to be made, and if such corrections are not made within a reasonable time, the grave marker or footstone, tombstone or other stone in question shall be removed.
All stones are to be set in the cemeteries in a straight and orderly manner. If any new stone is set within 14 inches of an existing stone, the foundation of the new stone shall come over and meet with the foundation of the other stone so as to eliminate any grass space between the two stones.
Footstones and grave markers in the cemeteries shall be set at ground level, and the width of a footstone or grave marker so set shall not exceed 16 inches. All foundations for tombstones, footstones or grave markers shall be of concrete, shall be at ground level height and shall be excavated in solid bearing soil and in no case less than eight inches thick.
A grave stone set in a section of either cemetery containing fewer than eight grave spaces shall not be more than 14 inches wide at the base. Such stones shall be on a concrete foundation of not less than eight inches in depth, and this foundation is to be not less than three inches nor more than four inches greater than the stone which is placed upon it as it surrounds the stone or marker. The foundation shall be brought to present grade so that no grass or vegetation will be permitted to grow around the stone.
A tombstone set in the center of a section of either cemetery containing eight or 10 grave spaces shall have a foundation of concrete not less than eight inches in depth and not to exceed four inches in width greater than the stone placed upon it as it surrounds the stone, and such stone, together with the four-inch-wide ledge, shall not exceed 36 inches in width.
All work done by any workman in the cemeteries with reference to setting of tombstones, footstones or grave markers shall be done in a good workmanlike manner, and it shall be in conformance with the usual requirements for such work.
