Any request for a public hearing may be withdrawn upon written request
signed by the original applicant submitted to the Secretary or other designated
official not less than 24 hours before the scheduled hearing with payment
of any required processing fee. When a public hearing request is withdrawn,
the original application fee is forfeited and the request, or one substantially
like it, cannot be scheduled again until a period of 12 months has elapsed.
Any future application will be treated like a new request and shall be subject
to all applicable fees, rules, regulations, and/or policies in place on the
date of the new application. If an applicant fails to request withdrawal within
the permitted time frame, the hearing will be conducted as scheduled and the
request requiring a public hearing may either be approved, tabled, or denied.
Any request for a public hearing may be continued upon written request
submitted to the Secretary or other designated official not less than 24 hours
before the scheduled hearing with payment of any required processing fee.
Any actual costs incurred as a result of such continuance shall be paid in
full by the applicant before the application is rescheduled for
another public hearing. If an applicant fails to request a continuance within
the permitted time frame, the hearing may be continued by majority vote or
the hearing may be conducted as scheduled and the request requiring a public
hearing may either be approved, tabled, or denied.
