The following words and phrases as used in this article shall have the
following meanings, unless a different meaning is required by context:
BENEVOLENT ASSOCIATION
The Police Benevolent Association which represents, for collective
bargaining purposes, the employees of the Police Department of the Village
and shall include the officers of such association.
COMMERCIAL COVENTURER
Any person who, whether or not for profit or other commercial consideration,
shall conduct, promote, underwrite, arrange or sponsor a sale, performance
or event of any kind which is advertised as benefiting, to any extent, the
charitable purpose of any organization representing the employees of the Police
Department of the Village.
CONTRIBUTION
The promise or grant of any moneys or property of any kind or value,
except payments by members of any organization for membership fees, fines
or assessments or for services rendered to individual members if membership
in such organization confers a bona fide right, privilege, standing, honor
or direct benefit, other than the right to vote, elect officers or hold offices.
PERSON
Any individual, organization, group, association, partnership, corporation
or any combination of them.
PROFESSIONAL FUND RAISER
Any person who, whether for or not for compensation or other consideration,
plans, conducts, manages or carries on any drive or campaign in this Village
for the purpose of soliciting contributions from persons residing in or from
persons, firms or corporations owning real property or conducting business
within the Village for or on behalf of any charitable purposes of a benevolent
association, whether or not such person engages in the business of or holds
himself out to persons as regularly or independently engaged in the business
of soliciting contributions for such purposes.
PROFESSIONAL SOLICITOR
Any person who is employed or retained, whether for or not for compensation,
to solicit contributions for charitable purposes from persons residing in
or from persons, firms or corporations owning real property or conducting
business within the Village.
No member of the Police Department of the Village and no benevolent
association shall:
A. Seek or solicit or authorize or permit any person or
entity on its behalf to seek or solicit contributions of any kind from any
resident of or from the owner of any real property located within the Village
or from any person, firm or corporation conducting business within the Village
by any means under any circumstances, including collection for charitable
purposes; provided, however, that if any such solicitation is for charitable
purposes, then any such solicitation may be authorized by resolution of the
Board of Trustees, subject to the terms and conditions of this article.
B. Utilize or permit the utilization of any moneys or contributions
stemming from solicitation for charitable purposes to be used for any other
purpose; provided, however, that use of any part of the funds collected to
reimburse the benevolent association for the actual costs of such solicitation
shall not be deemed to be a violation of this section.
If there is a violation of this article by any member of the Police
Department or by a benevolent association, then charges in connection therewith
shall be heard and determined by the Board of Trustees in the manner provided
by the rules and regulations of the Police Department and by § 8-804
of the Village Law, and punishment consistent with the provisions thereof
may be imposed by the Board of Trustees.
