While the value of pesticides in controlling undesirable insects, fungi
and rodents has been well established, the widespread and sometimes indiscriminate
use of pesticides, especially those pesticides which do not degrade rapidly
after use, has resulted in serious problems by disrupting the ecological balance,
by causing permanent injury or death to fish and wildlife, and by posing potential
threats to the health and welfare of the people. It is necessary, therefore,
in order to protect the health, safety and welfare of the residents of the
Village of Rockville Centre, to find a solution to such problems. It is the
purpose of this chapter to control the buildup of pesticide residues in the
environment, in fish and wildlife and in man, and to foster and stimulate
use of those pesticides that will break down most rapidly in the air, soil
and water.
No person, firm or corporation shall spray with, or apply to, or put
on the ground within the Village of Rockville Centre any of the following
chemicals: dieldrin, aldrin and dichlorodiphenyltrichloethane (DDT), or any
combination of chemicals which includes any of the above-listed chemicals;
provided, however, that such prohibition shall not be applicable to the use
of any such chemicals within a structure or building under such conditions
as to prevent the escape thereof from the confines of the structure or building,
and for the control of termites if such chemicals are injected into the ground
at a distance not more than one foot from the permanent exterior foundation
of the structure or building and to a depth of not less than one foot nor
more than four feet from the surface of the ground at the point of injection.
No person, firm or corporation operating a wholesale or retail establishment within the confines of the Incorporated Village of Rockville Centre shall sell, or permit the sale of, the chemicals listed in §
253-2 hereof unless it shall prominently display, at a place near the point where such sale is consummated, a sign not less than one feet by three feet in size, containing lettering not less than 3/4 of an inch, stating: "The application or spraying of dieldrin, aldrin and dichlorodiphenyltrichloetbane (DDT), or any combination of chemicals which includes any of the above-listed chemicals, within the Incorporated Village of Rockville Centre is prohibited by Chapter
253, Pesticides, of the Code of the Village of Rockville Centre."
Any person violating any provision of this chapter shall, upon conviction,
be punishable by a fine not to exceed $250 and, in addition thereto, such
violation shall constitute and is hereby declared to be disorderly conduct,
and any person violating the same shall be and is hereby declared to be a
disorderly person.
This chapter shall take effect December 1, 1970.
