The Board of Supervisors of Northumberland County, pursuant to § 57-26 of the Code of Virginia, as amended, does hereby adopt the following chapter authorizing establishment of cemeteries in Northumberland County.
No cemetery shall be established in Northumberland County unless it meets the requirements of Chapter 148, Zoning.
No cemetery shall be established in Northumberland County within 250 yards of any residence without the consent of the owner of the residence unless it is separated from the residence by a state highway. If it is separated by a state highway, it may be established upon such location without the consent of the owner of such residence if it be not less than 250 feet from the residence at its nearest point thereto.
No cemetery shall be established in Northumberland County unless authorization is obtained from the Board of Supervisors.
For the purpose of this chapter, authorization shall not be required for interment of the dead in any church yard or for interment of members of a family on private property.
Violations of the provisions of this chapter shall be punishable as a Class 1 Misdemeanor.
