For the purposes of this chapter, the following words and phrases shall
have the meanings ascribed to them in this section:
ALCOHOLIC BEVERAGES
All beverages as defined by the Alcoholic Beverage Control Law of
the state.
OPEN CONTAINER
Any container used to hold or carry liquids which is either open
or which is sealed with a cap or other seal, which cap or seal has been removed
or broken.
No person shall consume beer, wine, whiskey or other alcoholic beverages
on or in any public alley, highway, playground, sidewalk, street or other
City property unless otherwise authorized by the Public Safety Committee of
the City Council.
Possession of an open container, glass, can or other similar container having any beer, wine, whiskey or other alcoholic beverage upon one's person while in any of the public places enumerated in §
93-2 in this chapter shall be presumptive evidence of a violation of §
93-2.
No person licensed to sell beer, wine, whiskey or other alcoholic beverages shall permit consumption of the same in or upon any of the public places mentioned in §
93-2 within 25 feet of such person's place of business.
Any person who shall violate any provision of this chapter shall be punished as provided in Chapter
1, General Provisions, Article
I, Penalties.
