As provided in RSA 673:1 and in accordance with RSA 673:4-a, there is hereby established a Heritage Commission, to consist of five members plus not more than five alternate members as provided by law who shall be appointed by the City Council. One Commission member shall be a member of the local governing body. One member may be a member of the Planning Board. One Commission member shall be the City Historian as specified in § 31-33G below. The City Council shall act within 60 days to fill vacancies and unexpired terms. All members shall be residents of the City of Lebanon. In determining each member’s qualifications, the appointing authority shall take into consideration the appointee’s demonstrated interest and ability to understand, appreciate and promote the purpose of the Heritage Commission.
A. 
The Heritage Commission is established, as provided in RSA 674:44-a, for the proper recognition, use, and protection of resources, tangible or intangible, primarily man-made, that are valued for their historic, cultural, aesthetic, or community significance within their natural, built, or cultural context.
B. 
The Heritage Commission shall have all powers as provided in RSA 674:44-b, as that statute may be amended or changed in the future. The Heritage Commission shall adopt rules of procedure as required by RSA 676:1, including a code of conduct. The rules of procedure shall include administrative policies for the management, control, and operation of any property, both real and personal, received or acquired by the Heritage Commission as provided in RSA 674:44-b, II.
C. 
The Heritage Commission shall, as provided in RSA 674:44-b, III, assume the composition and duties of an Historic District Commission, including any and all powers granted by Article IV of the Lebanon Zoning Ordinance pertaining specifically to the Historic District. Members of the Historic District Commission shall serve out their terms as members of the Heritage Commission. Subsequently, regular Heritage Commission members and alternates shall serve a term of three years.

D. 
As provided in RSA 674:44-d, there is hereby established the Lebanon Heritage Fund. The City may appropriate money as deemed necessary to carry out the purposes of the Heritage Commission. The whole or any part of money so appropriated in any year and any gifts of money received pursuant to RSA 674:44-b, II, shall be placed in the Lebanon Heritage Fund and allowed to accumulate from year to year. Money may be expended from such fund by the Heritage Commission for its purposes without further approval of the local legislative body.
E. 
The municipal finance officer, pursuant to RSA 41:29, shall have custody of all moneys in the Lebanon Heritage Fund and shall pay out the same only upon order of the Heritage Commission. The disbursement of Lebanon Heritage Funds shall be authorized by a majority of the Heritage Commission. Prior to the use of such funds for the purchase of any interest in real property, the Heritage Commission shall hold a public hearing with notice in accordance with RSA 675:7.
F. 
The Heritage Commission shall assume the duties of the Dana House Committee and is, therefore, charged with: attending meetings, helping with the actual renovation/restoration work of the oldest existing house in Lebanon, developing a prioritized cost expenditure plan for preservation of the building's historical architecture, soliciting donations of cash, labor, and materials for renovating the building, developing a master plan for the restoration, future use, and maintenance of the building, and, with the help of City staff, preparing an annual operating budget to include backup information.

G. 
The City Historian is a position designed to provide outreach to Lebanon's students and citizens to encourage an interest in and further study of Lebanon's rich history. The City Historian may also serve as a mentor to one or more residents, particular younger residents and students, who are interested in working to preserve the City's heritage and assisting the Historian in his or her role. The City Historian shall be appointed by the Mayor and City Council for a period of three years. The position should be filled from recommendations made by citizens or citizen groups, such as the Heritage Commission, Historical Society, and others.[1][2]
