There is hereby created the Water-Sewer Department of the Borough of Rocky Hill which shall operate under the supervision, direction and control of the Mayor and Council of the Borough of Rocky Hill. The Water-Sewer Department shall consist of the Superintendent of the Water-Sewer Department and such additional employees as may, from time to time, be deemed necessary for the operation of the Department by the Mayor and Council of the Borough of Rocky Hill. The Superintendent of the Water-Sewer Department and all departmental employees shall be appointed by the Mayor and Council.
There is hereby created a Water-Sewer Utility Fund for the Borough of Rocky Hill, and the operation of the Water-Sewer Department shall be financed by an appropriation in the budget of the Water-Sewer Utility Fund. An appropriation for salaries and wages shall be likewise provided in the budget for the Water-Sewer Utility Fund, and the Superintendent of the Water-Sewer Department, together with any other departmental employees, shall receive such compensation as shall be determined by the Mayor and Council.
A. 
As used in this chapter, the following terms shall have the meanings indicated:
APPROVED
Refers to the approval of the Borough or the Superintendent.
BOROUGH
The Mayor and Council of the Borough of Rocky Hill.
DEPARTMENT and OFFICE
The Water-Sewer Department.
FIXED RATES
The rates or prices to be charged for the use of water and/or sewer, based upon the uses and utilities in use, and not measured by a water meter as hereinafter mentioned.
HOUSE CONNECTION
Any pipe together with necessary connections conveying sewage from a single building of any kind or sort to the sewer system.
MAIN (and its plural)
Any pipes other than supply pipes and service pipes used for conveying water or distributing it in the Borough.
METER RATES
The rates or prices to be charged for water and sewer based upon the quantity of water consumed as measured by a water meter or estimated in cases where no meter is used.
OWNER
Any person, persons, firm or corporation actually owning any property or premises supplied or prospectively to be supplied with Borough water or connected to the Borough public sewer, or his or their duly authorized agents. In the absence of instructions from the owner or his agent to the contrary, the occupant of any property or premises will be held to be the agent of the owner, in so far as his relation to the Water-Sewer Department may be concerned.
PLUMBING INSPECTOR
The Plumbing Inspector duly appointed by the Borough of Rocky Hill.
PREMISES
A building or part thereof occupied by one family only, together with the land connected therewith and such outbuildings as are used exclusively in connection therewith, or a single room or building occupied for business or other purposes by one person, organization, association, firm or corporation.
PUBLIC SEWER
Sanitary sewer or public stormwater drain as herein defined.
PUBLIC STORMWATER DRAIN
The system of drains, conduits, catch basins and the like, installed or maintained by the Borough in or near public streets, thoroughfares and easements for the purpose of removal of surface water and stormwater from the streets, lands and premises near or adjacent to the aforesaid system.
SANITARY SEWER
The system of conduits installed or maintained by the Borough of Rocky Hill in or near the public streets, thoroughfares and easements for the purpose of disposing of fluid waste other than stormwater.
SERVICE PIPE
The pipe extending from the curbline into privately owned land for supplying the premises with water.
SEWER EXTENSION
Any addition to the sanitary sewer, either privately or publicly owned, serving or which may serve two or more premises.
SUPERINTENDENT
The Superintendent of the Water-Sewer Department, or his properly authorized representative.
SUPPLY PIPE
A pipe tapped into the main and extending thence to and including the curb cock or valve on the curbline of the street.

The singular includes the plural, and the masculine includes the feminine, and "person" or "he" or "it" includes an individual, partnership or corporation.
Unless otherwise directed by the Mayor and Council, the Superintendent and all employees shall devote their whole time during hours prescribed for duty, diligently and loyally to the service of the Department. They shall properly care for and preserve the property of the Department and shall be held responsible for all such property under their control, and they shall promptly notify their superiors or the Superintendent of any defects, leaks, or injury in the mains, fixtures or attachments of the system or of any displacement or loss of tools and supplies. The Superintendent shall report monthly as to conditions and requirements of said Department to the Mayor and Council and shall report as required to state authorities.
The water mains and the public sewer of the Department are under exclusive control of the Borough, its authorized agents and employees. All other persons are forbidden to disturb, tap, change, obstruct access to or interfere with them in any way.

A. 
An application for Borough water or for the change of an existing supply shall be made to the Superintendent by the owner of the premises, in writing, and application must be made upon the form furnished by the Department therefor, and the applicant must subscribe to conditions thereon. The application must be accompanied by the permit fee.
B. 
Property owners who request a direct or indirect connection to the Borough water system are subject to payment of a connection charge in the sum of $2,475 for each connection unit and shall comply with all applicable law.
