[Adopted as Art. II of Ch. 22 of the 1970 Municipal Code]
A. 
The following conditions and regulations apply to all work authorized within street boundaries of the City of Hornell for repair and/or installation of water, gas, sewer, telephone and electric utilities and miscellaneous structures. These conditions and any special conditions which may be added to the street opening permit shall be enforced by the Department of Public Works.
B. 
All work in connection with an issued street opening permit shall commence within 30 days from the date of permit issuance, unless extensions are requested and approved by the Superintendent of Public Works.
A. 
All underground crossings shall be accomplished without disturbance to pavement unless otherwise approved by the Superintendent of Public Works.
B. 
Plans for underground utility projects shall be submitted and approved by the Superintendent of Public Works prior to commencement of the work. Such plans shall be to scale and shall contain the following information:
(1) 
The general scope of the work.
(2) 
The type of equipment and construction procedures to be followed.
(3) 
The size, type, locations and quantities of materials to be installed.
(4) 
The method of abandonment of any utilities retired upon completion of the work.
(5) 
Standard details showing the method of pavement restoration, topsoil and seeding, where required, and the method of replacing any other items removed or caused to be damaged because of the work.
(6) 
Necessary maintenance and the protection of traffic.
A. 
Installation, repair, replacement or maintenance of utilities requiring open excavation shall be permitted only by the Superintendent of Public Works.
B. 
Pavement removal shall be accomplished in such a way that will allow for proper restoration of the replacement section. Straight vertical cuts of the pavement will be required. Pavement that becomes undermined shall be cut back and removed.
C. 
Upon completion of the work, excavations shall be backfilled in such a way as to obtain maximum compaction. Gravel material for backfill shall be well-graded from coarse to fine and shall not exceed such size as will pass through a two-inch square hole; 30% to 65% by weight, shall pass through a one-fourth-inch square sieve, and not more than 10%, by weight, shall pass the No. 200 mesh sieve. Fill materials shall be placed in lifts and thoroughly compacted with no lift exceeding six inches in depth after compaction.
D. 
Pavement restoration shall be accomplished by placement of two courses consisting of an asphalt binder and an asphalt top material. Depth of the binder and top courses shall be thoroughly rolled to produce a smooth and uniform surface flush to the adjoining existing pavement.
E. 
All restoration work, including temporary patching until permanent restoration can be accomplished, is the sole responsibility of the permit holder. The city will, upon request, furnish the pavement restoration service at its cost. The cost of this work will be quoted to the contractor at the time the street opening permit is issued; and if the contractor chooses to utilize this service, the cost will be included in the street opening permit fee.
F. 
All other areas, such as curbing, grass lawns, sidewalks and any other features disturbed by the contractor, shall be repaired or replaced in kind.
G. 
Sidewalk replacement shall be performed in a neat and workmanlike manner. Handicapped person ramps shall be required at intersections.
H. 
No excavations will be allowed to remain open overnight except in extraordinary cases. By approval of the Superintendent of Public Works, steel cover plates may be used to cover the excavated area.
A. 
Traffic shall be maintained at all times during the progress of the work, and adequate signs, barricades and lights shall be provided. A plan for the maintenance and protection of traffic may be required. No lanes shall be closed without prior approval. Every contractor shall have an on-site representative who is responsible for the maintenance and protection of traffic.
B. 
The contractor shall erect and maintain suitable barricades around all trenches while the work is in progress and place advance warning signs for the protection of the public. All barricades and signs shall be suitably lighted by yellow lights at night.
C. 
No pavement openings are to be left unfilled over night except in extraordinary circumstances, and in such cases, precautions shall be taken to protect traffic. Prior approval must be obtained to use steel plating. Any open trenches in the street shall be barricaded and lighted at night. The Superintendent of Public Works, at his discretion, may require the contractor to provide a flagman during the progress of the work.
D. 
During winter conditions, the contractor must perform the work in such a way so that the street is free of obstructions that would interfere with snow and ice control operations.
Any interpretation of these requirements shall be made by the Superintendent of Public Works, who will decide matters of contractor compliance with the specifications.
Failure to comply with these requirements will result in revocation of the street opening permit and suspension from performing future excavations within the street boundaries of the City of Hornell.
Any violation of the provisions of this Article shall be punishable as provided in § 1-1 of this Code.
