This chapter shall be known and may be cited as the "Pedicycle Inspection Ordinance."
As used in this chapter, the following terms shall have the meanings indicated:
PEDICYCLE
Any device propelled by human power upon which any person may ride, having two tandem wheels or more, either of which is 18 inches or over in diameter.
From and after the effective date hereof, it shall be unlawful for any person to operate a pedicycle situated and commonly kept in Sayre Borough on any street or public place in Sayre Borough unless the same has been inspected and approved by the Chief of Police or his agent and registered with his office in the name of the owner for the current year and unless a registration tag or license for the current year issued by the borough is attached to the same by said Chief of Police or his agent. The Chief of Police or his agent shall refuse to register and issue a license tag for any pedicycle which fails to comply with the requirements of this chapter and state laws with respect to equipment and condition of the same and which is, in his judgment, in a condition too dangerous to be safely operated.
Registration and licensing provided for herein shall be effective to and including the following 30th day of April of each year, after which date a new registration and licensing shall be required for the ensuing one-year period.
It shall be the duty of the Chief of Police to keep and maintain in his office a record of all registrations and transfers made under the terms of this chapter.

A fee of $1 shall be collected for each registration from the registrant and shall include the cost of the registration and of the license tag. A fee of $0.50 shall be collected from the registrant for replacing a lost or defaced license tag.
In addition to other penalties prescribed by state laws and this chapter, the Chief of Police may, at his discretion upon finding that a pedicycle is being or has been operated in violation of the provisions of this chapter or of state laws, suspend the registration of said pedicycle for any period of time not exceeding three months and remove the license tag for such period. The Chief of Police shall suspend the registration and remove the license tag with respect to any pedicycle found by him to have become too dangerous in condition for safe operation or if it is determined by him that the pedicycle fails to have properly maintained items of equipment as required herein, and said suspension shall continue in effect until such time as said deficiencies have been corrected.
Any person riding a pedicycle shall become a pedestrian when he dismounts and proceeds on foot, pushing the pedicycle alongside him; in such case, the provisions of this chapter shall cease to apply to him, and he shall then be subject to the usual laws applying to pedestrians.
Notwithstanding anything herein to the contrary, the transfer of registrations, the nature and condition of equipment, the operation of pedicycles and penalties for violations of the foregoing and for violations of any provisions herein shall be governed by the then effective provisions of the Motor Vehicle Code of the Commonwealth of Pennsylvania.[1]

Any person, firm or corporation who or which shall violate or fail to comply with any of the provisions of this chapter shall, upon conviction, be sentenced to pay a fine of not more than $600 and costs of prosecution and, in default of payment of such fine and costs, be imprisoned for a term not exceeding 30 days.
