A. 
The number of licenses to sell alcoholic beverages at retail in the Borough of Allendale be and the same is hereby fixed for each classification of license as follows:
(1) 
Plenary retail consumption licenses: three.
(2) 
Plenary retail distribution licenses: four.
B. 
No other type of license to sell alcoholic beverages shall be granted in the Borough of Allendale.

The annual license fee for each type of license be and the same is hereby fixed as follows:
A. 
Plenary retail consumption license: $2,500.
B. 
Plenary retail distribution license: $2,500.

A. 
Plenary retail consumption licenses. No alcoholic beverages shall be sold, served or consumed on premises licensed for the sale of alcoholic beverages in the Borough of Allendale between the hours of 2:00 a.m. and 7:00 a.m. on weekdays or between the hours of 2:00 a.m. and 11:00 a.m. on Sundays. Anything herein to the contrary notwithstanding, it shall be permissible to sell, serve and consume alcoholic beverages on premises licensed for this purpose on January 1 of each year from 2:00 a.m. until 4:00 a.m.
B. 
Plenary retail distribution licenses. No alcoholic beverage shall be sold on premises licensed for the sale of packaged alcoholic beverages in the Borough of Allendale between the hours of 2:00 a.m. and 7:00 a.m. on weekdays and Saturdays and between the hours of 2:00 a.m. and 11:00 a.m. on Sunday.

No person shall possess, sell, distribute or transport alcoholic beverages within the Borough of Allendale in violation of the provisions of an act entitled "An Act Concerning Alcoholic Beverages," and amendments thereof and supplements thereto.
Not more than one license shall be granted to any person, corporation, partnership, limited partnership or association in said Borough, and said license shall cover only the licensed premises.

As used in this article, the terms and words as set forth below shall be defined as follows:
CENTRAL BUSINESS ZONE
The area as defined and described in the Zoning Ordinance of the Borough of Allendale and the Zoning Map included therein as defined in the provisions of Chapter 270, §§ 270-4 through 270-6, of the Code of the Borough of Allendale, and further described to include the following areas:
A. 
West Allendale Avenue from Franklin Turnpike to the Erie Lackawanna Railroad right-of-way.
B. 
Memorial Drive from West Allendale Avenue to West Orchard Street.
C. 
Maple Street from West Allendale Avenue to 250 feet northerly.
D. 
Myrtle Avenue from West Allendale Avenue to Central Avenue.
E. 
Central Avenue from West Allendale Avenue to Myrtle Avenue.
F. 
Rockland Electric Company right-of-way along the easterly side of Erie Lackawanna Railroad from Park Avenue to West Orchard Street.
G. 
Park Avenue from West Allendale Avenue to the Erie Lackawanna Railroad right-of-way.
H. 
Park Avenue from Erie Lackawanna Railroad right-of-way to 265 feet southerly of Erie Plaza.
I. 
Erie Plaza from Park Avenue to West Allendale Avenue.
CONSUMPTION OF ALCOHOLIC BEVERAGES
Drinking or possession in open containers or possession in nonoriginal containers of any alcoholic beverage as defined by the provisions of N.J.S.A. 33:1-1 et seq.
PERSON
Any natural person, corporation, firm, club, organization or partnership. The singular shall include the plural, and the plural shall include the singular. The masculine shall include the feminine.
PLACES OF PUBLIC USE
Any facility available for public use and convenience, including streets, highways, alleys, roads, sidewalks, parks or other public grounds, parking lots, train and bus depots, lavatories, rest rooms, vacant or unimproved Borough lands and other public or quasi-public places, excepting therefrom any premises or places specifically licensed for the sale or consumption of alcoholic beverages.
The consumption of alcoholic beverages, as described herein, is hereby prohibited in all places of public use, as defined herein, in the central business zone of the Borough of Allendale, excepting therefrom any premises specifically licensed for the sale or consumption of alcoholic beverages.

A. 
Any person under the legal age to purchase alcoholic beverages who knowingly possesses or consumes any alcoholic beverage in or on any school property, public conveyance, public place or place of public assembly or on private property shall be in violation of this article. Upon conviction, such underage person shall be subject to a fine of $250 for a first offense and $350 for any subsequent offense; have a New Jersey driving privilege suspended or postponed for six months; at the discretion of the court, perform community service for a period not to exceed 90 days; and, if considered necessary by the court, be referred to an alcohol treatment program at the defendant's expense. The penalty set forth herein shall apply only to a violation of this article.

B. 
This section shall not apply to persons under the legal age to purchase alcoholic beverages who possess or consume alcoholic beverages in the presence of and with the permission of the parent or legal guardian of said person, providing that said guardian is of the legal age to purchase alcoholic beverages or if alcoholic beverage is being consumed in any organized religious observance, ceremony or rite.
Any person who shall violate any of the terms and provisions of this article shall, for each and every violation, be subject to imprisonment in the Bergen County Jail for a period not to exceed 90 days or a fine not to exceed $500, or both, in the discretion of the Judge before whom such conviction may be had.
