This article is adopted in order to protect the health, safety and well-being of persons and property by prohibiting certain animals within the Borough of Allendale. The Board of Health of the Borough of Allendale finds and determines that the harboring of certain animals within the Borough may be offensive to other residents so as to constitute a public nuisance and may pose a threat to the safety of its inhabitants and their property.
It shall be unlawful for any person to keep, maintain, have in his or her possession or under his or her control or to permit another to keep, maintain or have under his or her control within the Borough limits of the Borough of Allendale any cattle, chickens, bees,[1] goats, guinea hens, hogs, horses, ocelots, pigs, (including potbelly pigs), pigeons, sheep, swine or any other animal that is deemed to be dangerous to humans. The foregoing enumeration is not intended to be all-inclusive. The determination of whether or not an animal is deemed to be dangerous to humans shall be made by either the Borough's Animal Control Officer or a police officer of the Police Department.

Any person that keeps, maintains or has in his or her possession or under his or her control any of the animals set forth in this article on the effective date hereof shall be permitted to keep and maintain said animal(s); provided, however, that such person may not increase the number of or replace such exempt animals. Any person having such exempt animal shall register such animal with the Animal Control Officer within 60 days from the effective date of this article.
This article shall be enforced by the Borough's Animal Control Officer and/or Police Department.
Any person who violates any provisions of this article shall, upon conviction thereof, be punished by a fine not exceeding $1,000 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
