[Adopted 12-28-1967 as Ch. 16 of the 1967 Code]
On or after the effective date of this article,
the Borough Council may let out and lease any privilege for the dispensing
of ice cream, soft drinks and food refreshments and similar foods
and beverages to any individual, firm, copartnership or corporation
desiring such a concession in any of the parks, swimming pools, public
resorts or recreation places owned by the Borough of Allendale, providing
there is compliance with the procedure and conditions hereinafter
provided.
The renting or leasing of concessions shall
be to the highest responsible bidder therefor, after advertisement
of the time and place of the receipt of bids for the same at least
10 days prior to the time set for such receipt of bids, in a newspaper
circulating in the municipality, and upon such terms and conditions
as may be prescribed. No concession may be operated nor the right
to operate a concession granted to more than one concessionaire for
each public park or other recreational place. No more than one concession
facility may at any time be operated in any such public park or other
recreational facility.
Concession facilities shall be operated at all
times in accordance with the following regulations:
A.
Days of operation. All days, excluding only those
set aside by resolution of the Governing Body permitting the exclusive
use of the public parks, resorts and recreational places by a specific
organization.
B.
Prices. The prices charged for any items sold by the
concessionaire shall be no greater than the prices charged for the
same or similar items in other locations operated by the concessionaire.
Violation of the terms upon which any lease
or privilege is granted will render the lease void, and, after reasonable
notice to the concessionaire, the Borough may re-enter any place so
leased and thereafter prevent the exercise of the privilege so forfeited
and may, after advertisement and receipt of additional bids, release
to the highest responsible bidder therefor.
Inspection and enforcement as provided for by
the terms of this article shall be vested in the Building Inspector
and the Sanitary Officer of the Board of Health of the Borough of
Allendale.
