The purpose and intent of this article is to establish regulations for the placement and pickup of residential trash and garbage, as hereinafter defined, within the Borough of Allendale.
As used in this article, the following terms shall have the meanings indicated:
ASHES
Includes the residue from coal or any other fuel which has been consumed.
GARBAGE
Includes waste or decayed animal and/or vegetable matter that has been used or was intended to be used as food and the waste therefrom, and dead animal or plant life or parts of the same.
GARBAGE CANS AND RECEPTACLES
Includes any metallic or plastic container with a proper cover, provided that, together with its contents, it does not weigh more than 60 pounds or measure more than 30 gallons.
REFUSE
Includes all broken crockery, household receptacles and utensils, paper products that are not recyclable (however, kraft bags may be used as liners for garbage containers), sweepings, old clothing and other ordinary household refuse, and excluding newspapers, building materials, stones, earth, lawn cuttings, hedge trimmings, leaves and garden growth, paint, motor oil and other toxic waste materials.
RESIDENCE and RESIDENTIAL PICKUP
Any residential property, condominium or rental residential property within the Borough of Allendale.
TRASH
Includes all readily combustible materials such as excelsior, noncorrugated cardboard boxes, crates and materials of a similar nature, household furnishings and appliances, including nonrecyclable white goods, and any other rubbish which is not constituted as garbage, ashes or refuse under the within definitions, but excluding building materials, stones, earth, lawn cuttings, hedge trimmings, leaves and garden growth, paint, motor oil and other toxic waste. In addition, the following recyclable items shall also be excluded: corrugated cardboard, high grade white paper, newspapers, magazines, shinies, catalogs and real estate multiple-listing books, ferrous metal (bimetal/tin cans and white goods), aluminum beverage cans, glass and plastics (containers composed of either PET or HDPE material).
Residential premises receiving municipal solid waste collection services shall comply with the following regulations:
A. 
All trash, as defined herein, shall be placed at curbside where easily accessible.
B. 
No trash or receptacles shall be set out prior to 6:00 p.m. on the night before collection. Any and all receptacles shall be removed by 9:00 p.m. on the day of collection. Any and all items not collected as trash shall be removed by 9:00 p.m. on the day of said trash collection.

C. 
When a regular collection day falls on a holiday, trash and receptacles shall not be set out until the next scheduled collection day and in compliance with these regulations.
Residential premises receiving municipal solid waste collection services shall comply with the following regulations:
A. 
Residential garbage, ashes and refuse, as defined herein, shall be collected from garbage cans and receptacles at the rear of the property within six feet of the driveway of each residence serviced.
B. 
Residential garbage, ashes and refuse, including garbage cans and receptacles, shall be placed for pickup no later than 6:30 a.m. on the day of collection.

The Recycling Coordinator, the Sanitation Officer, Code Enforcement Officials and members of the Police and Public Works Departments of the Borough are hereby authorized to enforce the terms of this article. Any person, residence owner, occupant and/or tenant who violates any provision of this article shall, upon conviction thereof, be liable to a penalty of not less than $50 nor more than $500 for each violation, in the discretion of the Municipal Judge. Each day a particular violation continues shall constitute a separate and distinct offense.
