The purpose of this article is to provide for the annexation by the City of certain territory of the Town and Village in accordance with and pursuant to Article 17 (the Municipal Annexation Law) of the General Municipal Law of the State of New York. It is the intent of this article to permit the City to complete the annexation of such territory based upon the following:
A. 
The governing board of the City, at a meeting held on December 17, 2007, as required by law having made a negative declaration under the State Environmental Quality Review Act and thereby having determined that the proposed annexation will not result in any adverse environmental impacts;
B. 
The governing board of the City, at a meeting held on January 28, 2008, as required by law having made the necessary findings and order that the proposed annexation is in the overall public interest, and the filing thereof in the offices of the clerks of the Village and Town, together with all other documents required pursuant to Article 17 (the Municipal Annexation Law) of the General Municipal Law;
C. 
The governing board of the Town, as required by law having made the necessary findings and order that the proposed annexation is in the overall public interest, and the filing thereof in the offices of the affected governments;
D. 
The governing board of the Village, as required by law having made the necessary findings and order that the proposed annexation is in the overall public interest, and the filing thereof in the offices of the clerks of governments.
In accordance with and pursuant to Article 17 (the Municipal Annexation Law) of the General Municipal Law of the State of New York, the City hereby annexes the following described territory situated within the Town and the Village, and thereupon, the City shall contain and include such property in addition to all of the territory heretofore contained within its boundaries:
All that tract or parcel of land, situate in the Town of Hornellsville, Village of North Hornell, County of Steuben, State of New York, more particularly described as follows:
Beginning at a point in the southerly line of Bethesda Drive and the easterly line of New
York State Routes 21 and 36. Said point of beginning being witnessed by a ROW Mon found 1.0' North and 0.6' West

Thence, North 69°03'56" East, continuing in said southerly line of Bethesda Drive, a distance of 175.58 feet to a point witnessed by a ROW Mon found 0.0' north and 0.0' east;

Thence, North 74°45'34" East, continuing in same said line, a distance of 143.39 feet;

Thence, North 81°52'48" East, continuing in same said line, a distance of 197.89 feet to a point witnessed by a Rebar found 0.0' north and 0.1' west;

Thence, South 05°02'02" East, a distance of 1455.35 feet to a point located near the approximate center line of the Canisteo River;

Thence, Northwesterly along the said center line of the Canisteo River, on a nontangent curve to the right, having an arc length of 674.11 feet, a radius of 1123.94 feet and an included angle of 34°22'40", said point being located along the easterly bounds of the relocated NYS Route 36 and 21 and the approximate center line of the Canisteo River;

Thence, North 20°50'51" West, continuing in same said line, a distance of 560.67 feet to the point of beginning.
Containing 1,509,956 square feet, (34.664± acres)
Intending to describe a parcel of land shown on map prepared by Clough Harbour and Associates, LLP titled "Survey for Lowe's Home Centers, Inc." project No. 14611, dated 10/1/05.
The above-described parcel is further designated as Tax Map Parcel Number 136.18-01.002.11 on the Tax Map of the Town of Hornellsville, Steuben County, New York.
