All electric-eye-controlled lampposts presently installed within the Borough of Silverdale or installed subsequent to the effective date of this chapter shall be kept at all times in working order and good repair by the owner, owners or tenants of the property upon which the lamp(s) is (are) located. The lamps shall at all times be operable automatically under control of the electric-eye device, and each lamp shall be illuminated by a light with an intensity of a one-hundred-watt incandescent bulb or its equivalent.[1]

Editor's Note: The preamble to this ordinance stated that certain residential dwellings had been or would in the future be constructed and occupied within the Borough pursuant to subdivision and land development agreements and/or building permits which require the owner or owners of the property to install electric-eye-controlled lampposts (referred to in the ordinance as "the lamp(s)") at the entry to every such residential dwelling and that the continued operation in good working order of the lamp(s) serves to provide illumination at or about the residential dwelling and the neighborhood within which it is located, thus serving the health, safety and welfare of the community. The enacting clause of the ordinance stated that the ordinance was enacted pursuant to the powers delegated to the Borough under Section 1202(74) of the Borough Code.
Upon failure or neglect of any said person to keep the lamp(s) in working order and good repair, the Building Inspector of the Borough of Silverdale shall give notice, in writing, to such person to comply with the requirements of this chapter. The notice shall provide that the lamp(s) be restored to working order within 15 days of the date of the dispatch of the written notice. Failure to comply with said notice within the fifteen-day period allowed shall constitute a violation of this chapter.
Any person who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $600, and costs of prosecution, or, in default of payment of such fine and costs, to undergo imprisonment for not more than 30 days. At the discretion of Borough Council, the Borough may cause the work to be done to restore the lamp(s) to working condition and collect the total cost thereof, plus 10% penalty, from either the owner, owners or tenant.
