The erection, construction, enlargement, alteration,
repair, moving, removal, demolition, conversion, occupancy, equipment,
use, height, area, and maintenance of all buildings and/or structures
in the Charter Township of East China shall be regulated.

Pursuant to Section 8b(6) of The Stille-DeRossett
Hale Single State Construction Code Act, 1972 PA 230, MCLA 125.1508b(6),
East China Township hereby elects to administer and enforce the 1972
PA 230 and the Michigan Building Code. East China Township shall also
administer and enforce the respective provisions of the Michigan Residential
Rehabilitation and Uniform Energy Codes and all applicable laws and
ordinances, and all subsequent amendments thereto. A government official
registered in accordance with 1986 PA 54 shall be appointed to receive
all fees, issue permits, plan reviews, notices, orders and certificates
of use and occupancy. All personnel performing plan reviews and inspections
shall be registered in accordance with 1986 PA 54.

A. Requirement established.
(1) For proper building inspections and payment of fees
and penalties. Cash performance bonds are required in order to assure
that all proper building inspections are completed and that all fees
and penalties owed to the Township pursuant to the Township Code of
Ordinances are paid.

(2) Valid period and forfeiture. Performance bonds will
be valid for a period not to exceed one year from the date of issuance
and shall be forfeited in its entirety to the Township after expiration.
B. Fees for performance bond. Prior to the issuance of
a permit required under this Building Code, a person to whom such
a permit is to be issued shall post a cash performance bond in the
following amount:

(1) For permits issued for work with a value of up to
$2,500: a cash performance bond of $50 shall be posted.
(2) For permits issued for work with a value of $2,500.01
to $10,000: a cash performance bond of $100 shall be posted.
(3) For permits issued for work with a value of $10,000.01
to $100,000: a cash performance bond of $300 shall be posted.
(4) For permits issued for work with a value of more than
$100,000.01: a cash performance bond of $1,000 shall be posted.
C. Deposit and return of bond.
(1) Deposit of money order or check. All cash performance bonds required by this section shall be posted by depositing in the offices of the Township Treasurer a bank money order or certified check in the amount specified in Subsection
B of this section prior to the issuance of any building permit.
(2) Return upon completion. Upon completion of the work
allowed pursuant to a building permit and upon satisfaction of all
other applicable requirements of this Building Code, including payment
of all fees and penalties owed to the Township, the person to whom
the permit was issued shall be discharged from his or her performance
bond, and any sums deposited pursuant to this section shall be returned
to him or her by the Township Treasurer after payment to the Township
of all fees and penalties.

(3) Only to individual bond issued to. The cash performance
bond may only be returned to the individual whose name the bond was
issued in upon completion of all inspections and payment of fees and
penalties.

D. Forfeiture of bond.
(1) Failure to schedule inspection. If any required inspections
are not scheduled by the person to whom any permit is issued and conducted
by the Township Building Official, a penalty of $50 for each will
be imposed against the bond posted pursuant to this section.
(2) Scheduling of inspections; penalty. All inspections required by this section, or any other section of the Township Building Code, shall be scheduled with the Township Building Official at least 24 hours in advance of the proposed inspections during normal business hours. Failure to schedule an inspection at least 24 hours in advance shall be subject to the same penalty as provided in Subsection
D(1) of this section.
(3) Penalties cannot exceed bond. In no event shall any penalties assessed pursuant to this subsection exceed the value of the performance bond posted pursuant to Subsection
B of this section.
