There is hereby adopted by reference in the Town the Virginia Uniform Statewide Building Code, including Part I, The Virginia Construction Code, 2015 edition; Part II, The Virginia Rehabilitation Code, 2015 edition; and Part III, The Virginia Maintenance Code, 2015 edition. The provisions of which are adopted and shall control all matters concerning the design, construction, alteration, addition, enlargement, repair, removal, demolition, conversion, use, location, occupancy and maintenance of buildings and all other functions which pertain to the installation of systems vital to buildings and structures in their service equipment, as defined by the Virginia Uniform Statewide Building Code, and shall apply to buildings or other structures in the Town.
A. 
The Town Council is responsible for the enforcement of the Virginia Uniform Statewide Building Code by hiring building officials or by contracting with other localities for the enforcement thereof; therefore, if the necessary contractual arrangements shall be made, the county may enforce the Virginia Uniform Statewide Building Code in the Town.
B. 
The Building Official shall issue a building permit only upon receipt of the following:

(1) 
A written certificate issued by the Town Council or its duly appointed agent approving the building project.
(2) 
A written certificate issued by the Town Council or its duly appointed agent stating that Town water and sewer service will or will not be furnished to the proposed building project.
(3) 
A written statement from the Carroll County Health Department stating that the subject property is suitable for the required septic system and/or water system in cases where the Town Council or its duly appointed agent has filed a certificate stating that water and/or sewer service will not be furnished to the proposed building project.
(4) 
A written certificate issued by the Town Treasurer stating that all delinquent taxes have been satisfied, as provided in § 15.2-2286, Code of Virginia.
C. 
The Building Official shall record and file all certificates mentioned in Subsection B above.
D. 
The Building Official shall notify the Town Council or its duly appointed agent, in writing, of the issuance of a building permit.

E. 
No certificate referred to in Subsection B above shall be issued by the Town Council or its duly appointed agent until the applicant has paid a fee as provided for in Subsection F below.

F. 
The Town Council shall establish a scheme of fees for the issuance of building permits and certificates.[1]

G. 
A permit issued in violation of this section shall be void.

A. 
The owners of property therein shall at such time as the Town Council may prescribe, remove, repair or secure any building, wall or any other structure which might endanger the public health or safety of other residents of the Town.
B. 
The Town Council through its own agents or employees may remove, repair or secure any building, wall or any other structure which might endanger the public health or safety of other residents of the Town, wherein the owner of such property after reasonable notice and a reasonable time to do so has failed to remove, repair or secure such building, wall or other structure. For purposes of this section, reasonable notice shall include a written notice mailed by certified or registered mail, return receipt requested, sent to the last known address of the property owner and published in a newspaper having general circulation in the Town in accordance with applicable provisions of § 15.1-504, Code of Virginia. No action shall be taken by the Town to remove, repair or secure any building, wall or other structure for at least 30 days following the later of the return of the receipt or the newspaper publication.
C. 
In the event that the Town Council through its own agents or employees removes, repairs or secures any building, wall or any other structure after complying with the notice provisions of this section, the cost of expenses thereof shall be chargeable to and paid by the owner of such property and may be collected by the Town as taxes and levies are collected.
D. 
Every charge authorized by this section with which the owner of any such property shall have been assessed and which remains unpaid shall constitute a lien against such property, ranking on a parity with liens for unpaid local taxes and enforceable in the same manner as provided in Articles 3 (§ 58.1-3940 et seq) and 4 (§ 58.1-3965 et seq.) of Chapter 39 of Title 58.1.

A. 
The Uniform Statewide Building Code, Part III, The Virginia Maintenance Code, 2015 Edition, is hereby adopted as the property maintenance code of the Town of Hillsville, in the Commonwealth of Virginia; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said property maintenance code are hereby referred to, adopted and made a part hereof, as if fully set out in this section, with the additions, insertions, deletions and changes, if any, prescribed in Subsection B of this section.

B. 
Nothing in this section or in the property maintenance code hereby adopted shall be construed to affect any suit or proceeding impending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Subsection B of this section; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this section.
C. 
The Town Manager shall certify to the adoption of this section, and cause the same to be published as required by law; and this section shall take effect and be in force from and after its approval as required by law.
