§ 257-1 Purpose.

All territory within the boundaries of the Town of Lake Tomahawk shall be placed into one of the dwelling districts created in this chapter.

§ 257-2 Dwelling District No. 1.

Any site-built dwelling, manufactured building, or double-wide manufactured home shall be permitted in this area subject to the following minimum requirements:
A. 
The minimum width between the longest sides of the structure is 24 feet.
B. 
The footprint of the dwelling must be 576 square feet or greater in size. This size requirement does not apply if all the following conditions are met:
(1) 
The property is zoned Forestry;
(2) 
The property is at least 10 acres in size;
(3) 
The minimum width between the longest exterior sides of the structure is 18 feet;
(4) 
The structure is located at least 100 feet from all adjoining properties;
(5) 
The structure shall not be used as a permanent residence.
C. 
The structure has a shingled pitched roof with a minimum pitch of 3/10 to 12 with a minimum roof overhang of not less than six inches on all sides. The minimum roof overhang requirement maybe waived if that applicant demonstrates that the roof overhang component of the designed structure would exceed the maximum width of a structure which can be legally transported over public highways and roads between the manufacturing site and the intended location and occupancy site.
D. 
Porches, garages, breezeways, storage appurtenances, carports, and basements shall not be included in calculating the minimum square footage.
E. 
All buildings must meet the requirements of Chapter 162 of the Town of Lake Tomahawk Ordinances.

§ 257-3 Dwelling District No. 2.

Any site-built dwelling, manufactured building, or double-wide manufactured home shall be permitted in this area subject to the following minimum requirements:
A. 
The footprint of the dwelling must be 576 square feet or greater in size.
B. 
The structure has a shingled pitched roof with a minimum pitch of 3/10 to 12. Eave overhangs of six inches or greater are required. Finished roofing material shall be shingles or other acceptable roofing materials.
C. 
Any space between the dwelling and the grade or slab shall be enclosed with materials compatible in design and appearance with the exterior of the building.
D. 
Porches, garages, breezeways, storage appurtenances, carports, and basements shall not be included in calculating the minimum square footage.
E. 
All buildings must meet the requirements of Chapter 162 of the Town of Lake Tomahawk Ordinances.

§ 257-4 Dwelling district designation.

All lands within the Town of Lake Tomahawk will be in Dwelling District No. 1, except the following, which will be in Dwelling District No. 2:
A. 
Hideout Lane subdivision.
B. 
Existing mobile home parks and campgrounds existing at the time of adoption of this chapter, including,
(1) 
Dunhams Seasonal Home Park.
(2) 
Waters Edge Campground and Home Park.

§ 257-5 Preexisting dwellings.

Any site-built dwelling, manufactured building, or double-wide manufactured home existing at the time of enactment of this chapter that does not meet the requirements of this chapter, in either district, shall be allowed to remain until such time as the dwelling is removed or destroyed in excess of 50% of its assessed value. All new building permits must meet the new requirements.

§ 257-6 Building permits.

No building permits shall be issued by the Building Inspector for a dwelling that fails to meet the standards of this chapter.
