Pursuant to the authority invested in the Madison
Board of Selectmen by 29-A M.R.S.A. § 2395, the Madison
Board of Selectmen hereby finds the following:
A. During certain times of the year, the road base of
certain roads is insufficient to sustain motor vehicle traffic whose
weight, loaded or unloaded, exceeds 23,000 per square foot.
B. It is in the public interest to limit traffic on Town
ways during certain times of the year to protect those designated
roads from damage caused by heavy vehicles.
Vehicles or combination vehicles exempt from
this rule and regulation are:
A. Any vehicle or combination of vehicles, with or without
a load, registered for a gross weight of 23,000 pounds or less; and
B. Any vehicle or combination of vehicles registered
for 23,000 pounds without load other than tools or equipment necessary
for the proper operation of such vehicle or combination of vehicles;
and
C. Any vehicle engaged in highway maintenance under the
direction of the Maine Department of Transportation (DOT) or the Town
of Madison; and
D. Any two-axle home heating fuel delivery truck registered
in excess of 23,000 per square foot, with an exemption certificate
issued by Maine DOT, carrying a partial load and having a gross weight
of 23,000 pounds or less; and
E. Any vehicle engaged in the transportation of bulk
milk or bulk feed which is registered in excess of 23,000 pounds with
an exemption certificate issued by Maine DOT carrying a partial load
having a weight equal to or less than indicated on the exemption certificate
as documented by delivery slips or bills of lading carried in the
vehicle. The allowable weight indicated on the exemption certificate
will be calculated based on various reduced loads per inch width tire,
manufacturer's rating.
This rule and regulation shall not apply to
any section of highway which has been closed when that section of
the highway is solidly frozen.
