The developer, in order to ensure review of
the Commission at its regular meetings, shall file with the staff
of the Commission six black-line prints of the concept plan at least
two weeks prior to such regularly scheduled Commission meeting. If
a sketch plan has been submitted and evaluated by the Commission,
the developer is encouraged to incorporate the results of the evaluation
into the concept plan.
A concept plan for a subdivision of land in
any zoning district may be approved by the Commission subject to the
following conditions:
A. The property which is proposed to be subdivided shall
be posted by the Town within seven days of submittal of the concept
plan and shall remain posted for a period of 30 days so that the public
is made aware of the possible use of the property. The sign shall
be no less in size than 22 by 28 inches.
B. The developer will submit the plan for the proposed
subdivision at a Commission meeting and will simultaneously submit
the plan to the county, when applicable, for its review. The Zoning
Administrator will complete a study for the Commission to be submitted
at or before the next (2nd) Commission meeting. The study will be
an overview of how the proposed plan relates to the surrounding area
and if it is zoned properly and may include any information the Zoning
Administrator is able to provide so that the Commission may reach
an informed decision. The Commission shall review the study and may
vote on the approval of the proposed subdivision as early as the next
(3rd) Commission meeting.
C. The Commission shall consider whether the proposed
subdivision is in conformance with the Town of Hampstead and Environs
Comprehensive Plan.
D. The Commission shall consider whether the proposed
subdivision is in conformance with the Carroll County Water and Sewer
Master Plan.
E. The Commission shall consider whether the proposed
subdivision will violate the provisions of any enforceable deed restrictions
or covenants attached to the property.
F. The Commission shall consider whether the proposed
subdivision will add to or create an inadequacy to any street, street
section, or intersection.
G. The Commission shall consider whether the proposed
subdivision will add to or create an inadequacy of any public school
expected to service the proposed subdivision.
H. The Commission shall consider whether the proposed
subdivision will add to or create an inadequacy in fire protection,
police protection, emergency services, recreation facilities, water
facilities and/or sewerage facilities.
I. The Commission shall require that public comments
be heard prior to a Commission vote on a proposed subdivision and
that all persons present at the meeting be allowed to address the
Commission.
