It is the intent and purpose of the President and Commissioners of the Town of Princess Anne to provide by this chapter for the sanitary collection and disposal of waste within the Town.
As used in this chapter, the following terms shall have the meanings indicated:
GARBAGE
Waste foodstuffs or table wastes of animal or vegetable origin.
REFUSE
Garden, lawn or tree trimmings, limbs, leaves, small household items (such as small microwaves, fans, kitchen chairs, small tables, etc.), major appliances (such as refrigerators, stoves, washers, dryers, freezers, console televisions, dishwashers, etc.), furniture (such as sofas, overstuffed chairs, bureaus, chests of drawers, box springs and mattresses, etc.) and tires.
RUBBISH
The waste material from normal living conditions and business operations, but not including garbage or refuse.
WASTE
All of the above.
A. 
All waste accumulated in the Town shall be collected, conveyed and disposed of by the Town except as follows:
(1) 
In a C-2 Zoning District, no collections shall be made from industrial establishments, commercial establishments or any residential or nonresidential establishments operating for a profit, other than apartment houses of six or fewer units or residences approved by the Code Compliance Officer.
(2) 
In a C-1 Zoning District, no collections shall be made from apartment houses of more than six units.
(3) 
In all Zoning Districts, no collections shall be made from food service establishments.
(4) 
In all Zoning Districts, no collections shall be made for bulk pickup resulting from commercial or residential evictions. The property owner shall be responsible for bulk pickup of garbage, refuse or rubbish resulting from a commercial or residential eviction.
B. 
The Town shall determine the schedule for waste collection and bulk pickup.
C. 
This chapter does not prohibit collectors of waste from outside the Town from hauling such over Town streets, if such collectors comply with the provisions of this chapter and with any other governing law or ordinance.
A. 
Garbage and rubbish shall be placed and stored in the following manner: in a plastic bag that is closed and tied securely and placed in a metal or hard plastic container with a maximum size of 30 gallons and having a secure lid.
B. 
Failure to secure rubbish and garbage as described above, or allowing rubbish and garbage to be visible, protrude, leak, seep or otherwise become loose, shall be a violation of this chapter.
C. 
Producers of waste or the owners of premises upon which such has accumulated, utilizing dumpsters to collect, convey or dispose of waste, shall meet each of the following requirements:
(1) 
The dumpster shall be located, within reason, to minimize conflicts with nearby dwellings.
(2) 
The dumpster shall be screened on three or four sides, as needed, to block views from public streets or dwellings on abutting lots, with such screening composed of an attractive, weather-resistant, mostly solid wood fence, decorative masonry wall, evergreen plants or structure designed to be architecturally compatible with the principal building.
(3) 
The dumpster shall not be located within 10 feet from a street (not including an alley) nor within the right-of-way of any street.
(4) 
The dumpster shall not obstruct safe sight distances for traffic and pedestrians.
(5) 
The dumpster shall not obstruct views of traffic signs or street signs and shall not be located on a sidewalk.
(6) 
The dumpster shall not be located within 15 feet of a window or door of dwellings on another lot.
(7) 
Licensed contractors must perform construction of required enclosures and apply for the proper building permit(s). The permit application must be accompanied by a current survey or an accurate site plan of the property showing the proposed location and size of the enclosure. Adjacent property lines, public rights-of-way and building location must also be shown on the survey or site plan to ensure the enclosure will comply with setbacks.
A. 
Refuse or materials other than rubbish or garbage shall be picked up in accordance with rules established by the Commissioners.
B. 
Requests for refuse pickup must be made no later than 4:00 p.m. on the day prior to pickup. The fees for refuse pickup shall be established by the Commissioners and posted in Town Office.
For the purposes of Town correction and disposal, property owners shall be responsible for placing waste material containers at the curbline of their property, as established by the Code Enforcement Officer, not earlier than 6:00 p.m. on the day before scheduled collection nor later than 7:30 a.m. on the day of scheduled collection. Containers shall not remain at the curbline later than 9:00 p.m. on the day of collection.
A. 
Each property owner who receives Town waste collection and disposal services shall pay disposal fees for such services. An owner of a structure containing six or fewer shall pay a disposal fee for each unit within the structure. The disposal fee shall be for each fiscal year beginning on July 1 and ending on June 30, and shall be established annually in the Town Budget Ordinance. The disposal fee shall be paid prior to receiving the service, but no than 20 days after the Budget Ordinance becomes effective.
B. 
The disposal fee shall not be prorated.
C. 
In a financial hardship case as determined by the Town Manager, the disposal fee may be paid in installments during the fiscal year.
D. 
The waste collection and disposal services of the Town are mandatory for all property owners set forth in § 131-3.
E. 
Nonpayment. When the full amount due the Town is not paid by a property owner on or before August 31 of each year, the property owner shall be assessed a late fee equal to 25% of the amount of the disposal fee; and if the full amount due the Town is not paid on or before September 30 of each year, then the property owner shall be assessed a late fee equal to an additional 25% of the amount of the disposal fee. Any fees or charges remaining unpaid after September 30 of each year shall be recorded in the Town records against the owner of the property, and, if not sooner paid, such amount shall be collectible in the same manner as real estate taxes are collected.

Violation of any provision of this chapter, except a violation of § 131-7, shall be declared to be a municipal infraction and shall be subject to a penalty as provided in Chapter 1, General Provisions, § 1-8, of this Code.
