When any vehicle is parked or abandoned on any
highway within the Town of Goshen, outside the village located within
such Town, during a snowstorm, flood, fire or other public emergency
which affects that portion of the public highway upon which said vehicle
is parked or abandoned, said vehicle may be removed by the Town Highway
Superintendent.
After removal of any vehicle as provided in
this article, the Town Highway Superintendent may store such vehicle
in a suitable place at the expense of the owner. Such owner or person
in charge of the vehicle may redeem the same upon payment to the Town
Highway Superintendent of the amount of all expenses actually and
necessarily incurred in effecting such removal, such removal charges
not to exceed $25, together with any charges for storage, such storage
charges not to exceed $5 per day or fraction thereof.
The Town Highway Superintendent shall without
delay report the removal and the disposition of any vehicle removed
as provided in this article to the Town Clerk, and it shall be the
duty of such Town Clerk to ascertain to the extent possible the owner
of the vehicle or person having same in charge and to notify him of
the removal and disposition of such vehicle and of the amount which
will be required to redeem same.
Any person, firm or corporation who violates
the provisions of this article shall be guilty of an offense punishable
by a fine of not more than $50 or by imprisonment, in the case of
an individual, for not more than 10 days, or by both such fine and
imprisonment. In addition to the above-provided penalty and punishment
for violations of this article, the Town Board may also maintain an
action or proceeding in the name of the Town in a court of competent
jurisdiction to compel compliance with or to restrain by injunction
any violation of this article.
