It shall be unlawful for any person or persons
to harbor or keep any geese or other poultry or to suffer or permit
any geese or other poultry to run at large within the bounds of Dover.
It shall be the duty of the poundkeeper, and
it shall be lawful for any other person, to take up and confine in
the pound of said town any and all geese and other poultry found running
at large within the bounds of said town. For each and every head of
geese or other poultry so taken up and delivered to the poundkeeper,
the person or persons so delivering the same shall be entitled to
receive $0.25 per head from said poundkeeper, and it shall be the
duty of the poundkeeper to pay the same on it being established that
such poultry were legally confined, and if the owner or owners of
such poultry appear and claim the same, they shall be delivered up
by said poundkeeper upon the payment to him of the sum of $0.50 per
head, and all expenses of keeping said poultry while in his custody,
which sum of $0.50 per head shall be retained by said poundkeeper,
and 1/2 thereof paid by him to the person or persons bringing said
poultry to the pound.
If no person appears within the space of 24
hours to claim said poultry, it shall be the duty of said poundkeeper
to give notice to the owner or owners thereof of the fact of their
confinement, if said poundkeeper knows who the owner or owners are,
or if they can be easily found, and then if such poultry are not claimed
and all expenses paid within three days from the time of their confinement
or in case the poundkeeper cannot find the owner thereof, it shall
be the duty of the poundkeeper to give notice of the circumstances
of the case to the Mayor, Clerk or either of the Aldermen of the town,
who are severally authorized to issue a precept to the Chief of Police
to make public sale by notices signed by himself and set up in three
public places in said town, and said Chief of Police having so advertised
shall sell such poultry, and out of the proceeds of such sale shall
pay to the poundkeeper the sum of $0.50 per head for the poultry so
sold, and also all costs in the premises, and shall pay the surplus,
if any, to the Treasurer of the town for the owner or owners of such
poultry, such surplus to be paid over upon the fact of such ownership
being established to the satisfaction of the Mayor, and so certified
by him to the Treasurer; provided that such claim of ownership be
made and established within six days after such sale, otherwise such
surplus to remain in the treasury for the use and benefit of the town.
