All sidewalks and curbs shall be of concrete
or belgium block construction in accordance with the regulations and
specifications hereinafter set forth. Specifically excluded from this
requirement, however, is any curbing installed by the Town of Dover
to ensure proper drainage. Such curbing installed by the Town of Dover
may be of bituminous material.
The cost of the sidewalk shall be paid by the
property owner and the curb by the Town if the property owner shall
voluntarily construct the curb and sidewalk according to this article.
Should it become necessary for the Town to cause the construction
of said sidewalk, the cost thereof shall be assessed against the property
owner and collected in the same manner as taxes. Should the property
owner desire to construct his sidewalk, contractors bidding for such
work may also at the same time give a separate bid for the curb, which
shall be subject to the approval of the Street Committee, before any
construction work is begun.
It shall be the duty and obligation of all property
owners in the Town of Dover to install curbs and to pave the sidewalks
from the curb to the building line in accordance with the specifications
contained in this article.
Where sidewalks are constructed by the Town
with funds from other sources, there shall be no financial obligation
on the part of the property owner.

It shall be required as a condition for the
issuance of a building permit for any new construction (not including
renovations), whether residential, commercial or industrial, that
sidewalks and curbs be installed along the frontage of any public
street upon which the lot or parcel to be built upon has frontage,
in accordance with the terms and specifications for sidewalks and
curbs as established by this article. No certificate of occupancy
shall be issued until the sidewalks and curbs have been properly installed.

The Mayor and Board of Aldermen, upon recommendation
of the Town Engineer, may grant an exception to the requirement of
installing sidewalks where there are no existing sidewalks on abutting
property to the property upon which new construction will take place.
