As used in this article, the following terms
shall have the meanings indicated:
HIGHWAY
The entire width between the boundary lines of every way
publicly maintained when any part thereof is opened to the use of
the public for purposes of vehicular travel, which shall include the
shoulder of a road in addition to the improved roadway.
REPAIR
Repair of any motor vehicle, but shall not mean repairs necessary
to move the vehicle because it is inoperable or incapable of being
removed without such repair. For example, fixing a flat tire or the
jump starting of a battery are types of "repairs" not included in
this definition, while the changing of oil, spark plugs, muffler replacement,
battery replacement or things of such nature, which are generally
considered normal routine maintenance or which are not necessary to
be completed prior to moving the automobile from the street or highway,
shall be included in said definition.
It is hereby prohibited on any streets or highways
located within the Town of Dover to perform repairs on motor vehicles
as defined herein.

Any person, firm or corporation who or which
shall violate any of the provisions of this article shall be subject
to one or more of the following: a fine not exceeding $1,250, a term
of imprisonment not exceeding 90 days or a period of community service
not exceeding 90 days.
