The purpose of this chapter shall be to provide
rules, regulations and standards to guide the subdivision of land
in the Township of Evesham in order to promote the public health,
safety, convenience and general welfare of the Township. It shall
be administered to ensure orderly growth and development; the conservation,
protection and proper use of land; and adequate provision for circulation,
utilities and services.
The provisions of this chapter shall be administered
by the Planning Board of the Township of Evesham and the Zoning Board
of Adjustment of Evesham Township, as applicable, in accordance with
the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq.
The provisions of the New Jersey Residential
Site Improvement Standards, N.J.A.C. 5:21-1 et seq., shall govern
and control over the provisions of this chapter for residential subdivisions.
This chapter shall apply, however, to nonresidential subdivisions.
In the Pinelands Area of Evesham Township, all applications for development approval reviewed under this chapter shall comply with the development standards of Chapter
160, Zoning, of the Code of the Township of Evesham and also shall comply with the review procedures of Chapter
15, Land Use Administration, of the Code of the Township of Evesham.
