A. 
There is hereby established in the City of Garfield a State Uniform Construction Code enforcing agency to be known as "Department of Inspections," consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official, Fire Protection Subcode Official, Elevator Subcode Official, and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency.
B. 
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217 (N.J.S.A. 52:27D-119 et seq.), as amended, and N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23 to hold each such position.
C. 
The public shall have the right to do business with the enforcing agency at one office location except for emergencies and unforeseen or unavoidable circumstances.

The City of Garfield hereby establishes, acknowledges and designates that it will be subject to the jurisdiction of the Bergen County Board of Appeals.

All building permit fees and subcode fees shall be determined in accordance with the provisions of N.J.A.C. 5:23-4.20(c), except as follows:
A. 
For the development of more than three residential dwelling units, the new construction fee shall be in the amount of $0.035 per cubic foot of volume.
B. 
The minimum fee for any subcode, notwithstanding the provisions of the aforementioned state code shall be $65.
C. 
Mechanical Inspector fee (r-3, r-4, r-5 use groups only and does not include the electrical subcode) shall be as follows:
(1) 
A minimum fee: $65.
(2) 
Heat-producing appliances (i.e., furnace, boilers, gas fireplaces and stoves): $91.
(3) 
Replacement of a nontestable backflow preventer with another appliance: $91.
(4) 
Replacement of nontestable backflow preventer alone: $91.
(5) 
Chimney liner: $91.
(6) 
Generators: $91.
(7) 
Residential gas pipe: $15.
(8) 
Water heater: $91.
(9) 
All other (duct work, hydronic heating, etc.): $91.
(10) 
Condensate line: $91.
(11) 
Installation of LPG tank: $92.
(12) 
Fuel oil piping: $15.
(13) 
Oil tank installation: $92.
D. 
The Mechanical Inspector fee applies only to the installation of the specific residential mechanical equipment listed when it is not part of a larger multi-subcode residential project. When mechanical equipment is being installed as part of a larger project the fees under the individual subcode sections shall apply.
E. 
The Mechanical Inspector fee section does not apply to any commercial installation.

Prior to the issuance of permit for the demolition or construction of any structure, the person, firm or entity making such application for a permit shall post with the Construction Official, security in the form of cash, certified check or surety bond issued by a surety company authorized to do business in New Jersey. Such security shall be in the amount of $3,000 for one- and two-family homes and accessory buildings and $10,000 for all other buildings. The purpose of the security or condition of the bond shall be to insure that the demolition and/or construction shall have been performed in a good and workmanlike manner as well as to guarantee compliance with the requirements of the Bergen County Utilities Authority and the Garfield Code regarding mandatory recycling of construction and demolition debris. The beneficiary of the security shall be the owner or owners of the land and any persons having an interest in the realty involved on which the construction and/or demolition is taking place and the term of any security, be it cash, certified check or surety bond, shall terminate no earlier than the expiration date of the construction and/or demolition permit, plus an additional 30 days.

All newly constructed one- and two-family buildings independent of a housing development with truss construction shall have identifying emblems permanently affixed to the front of the structures as required by N.J.A.C. 5:70-2.20.
A. 
The emblem shall be of a bright and reflective color, or made of reflective material. The shape of the emblem shall be an isosceles triangle, and the size shall be 12 inches horizontally by six inches vertically. The following letters, of a size and color to make them conspicuous, shall be printed on the emblem:
(1) 
"F" to signify a floor with truss construction;
(2) 
"R" to signify a roof with truss construction; or
(3) 
"F/R" to signify both a floor and roof with truss construction.
B. 
The truss emblem shall be permanently affixed to the left of the main entrance door at a height between four feet and six feet aboveground and shall be installed and maintained by the owner of the building.
