The Village of Williamsville elects to adopt the procedures established by Chapter 738 of the Laws of 1977, General Municipal Law § 22 and Insurance Law § 33-a and 168-c, which authorize and empower a claim by the village against the proceeds of a policy of fire insurance insuring the interest of an owner and issued on real property located in the Village of Williamsville to the extent of any lien by the village thereon.
Upon the written agreement of an insured to restore the affected premises to the same or improved condition that it was in prior to the time that the lien of the Village of Williamsville arose against the proceeds of insurance, the Village Board may by resolution release or return to the insured any amounts which the village would be entitled to claim under the provisions of § 22 of the General Municipal Law, subject to such conditions as the resolution may provide to guarantee the obligation of the insured to restore the affected premises.
