Every retail food establishment, with the exception
of Risk Type 1 establishments, shall be required to have at least
one person in charge (as defined in N.J.A.C. 8:24-1.5) of the food
operation who shall attend and successfully complete a food service
training course according to the following schedule:
A. Risk Type 2 establishments: At a minimum, at least
one person in charge shall be employed who has attended and successfully
completed a food service training course as provided by or approved
by the Manalapan Township Health Department or has obtained a food
safety certificate by passing an examination administered by an accredited
certifying program recognized by the Conference for Food Protection
within six months of the opening of the retail food establishment.
B. Risk Type 3 and 4 establishments: By January 2, 2010,
at least one person in charge shall be employed who has obtained a
food safety certificate by passing an examination administered by
an accredited certifying program recognized by the Conference for
Food Protection, within six months of the opening of the retail food
establishment. Prior to January 2, 2010, the food service training
requirements for Risk Type 2 establishments will apply.
The person(s) in charge who satisfies the food
service training requirements of this article is expected to attend
and successfully complete additional training once every three years,
except for accredited Conference for Food Protection trainings, which
shall be repeated every five years. The training requirements shall
be completed within the certification period. A recertification fee
of $25 shall be assessed if a training certificate lapses for 30 days.
There shall be a person or persons available
to the retail food establishment during its hours of operation and
any time during an emergency who has successfully completed one of
the Manalapan Health Department approved training courses within the
last three years or one of the accredited Conference for Food Protection
trainings within the last five years.
For training not directly provided by the Manalapan
Township Health Department, the ownership must submit satisfactory
evidence of completion of the food service training to the Health
Department for verification of compliance.

The owner of a retail food establishment will pay a penalty of $100, as permitted by N.J.S.A. 26:3-70, upon proper notice to retail food establishment by the Township of Manalapan, if it fails to submit documentation of appropriate training, as set forth in §
256-9, within six months of the opening of the establishment or within six months of the expiration of training as set forth in §
256-7. Failure to pay the penalty upon proper notice will subject the establishment to a license revocation hearing as set forth in §
256-20B. Any notice required to be given under this article shall also be sent to a nonlicensed owner of any establishment in the event that a license holder is the operator.
