[HISTORY: Adopted by the Mayor and Council of the Town of Rock Hall 7-5-1979 by Ord. No. 79-3. Amendments noted where applicable.]
The flag, a copy of the design of which is attached hereto and made a part hereof,[1] is hereby declared to be the official Municipal Flag of the Town of Rock Hall, Maryland, and is hereby authorized to be displayed by all appropriate municipal agencies and departments. The flag is also described herein as follows: a likeness of the Town Seal in white is centered on a background of royal blue.

The design of said flag shall be registered as a trademark or service mark with the Secretary of State of Maryland pursuant to the provisions of Article 41, Sections 90 through 103, of the Annotated Code of Maryland (1971 Replacement Volume, 1972 Cumulative Supplement),[1] provided that said design is accepted for registration by the said Secretary of State. The design of said flag may also be copyrighted or otherwise registered as a trade or service mark pursuant to any applicable federal statutes.

It shall be unlawful for any person, persons, corporation, partnership, firm or other legal entity, except the Mayor and Council of Rock Hall, to display the flag or its design in any product or to sell at retail or wholesale any product in any part of which said flag or its design is incorporated or displayed or to otherwise utilize said flag or its design unless permitted by the Mayor and Council. The unpermitted use of the flag or its design shall be considered as an unlawful act.

Violations of this chapter shall be punishable as a municipal infraction. Violators shall be subject to a fine not to exceed $100. Repeat offenders may be assessed a fine not to exceed $200 for each repeat offense.
