A. 
The construction of ponds within the municipal boundaries of the Town of Rock Hall is prohibited.
B. 
For the purposes of this chapter, a "pond" is defined as a man-made body of standing water without current or outlet and is of earthen or dirt construction on the sides and bottom.
The provisions of this chapter are not to be construed to affect any other man-made construction which is chlorinated, fenced, filtered and sanitized and is covered on the sides and bottom with an artificial fabrication, including but not limited to plastic, concrete or metal.

Violations of this chapter shall be punishable as a municipal infraction. Violators shall be subject to a fine not to exceed $100. Repeat offenders may be assessed a fine not to exceed $200 for each offense.
