Paying for parking using credit card, pay by phone or on-line application shall be subject to a City convenience fee not to exceed $0.50 per transaction, plus any additional fees that may be charged by any third-party vendor not within the City's control, including but not limited to a credit card company.

A. 
No vehicle shall be parked on the streets or parts of streets constituting an area designated in Subsection E during the hours designated in Subsection E unless:

(1) 
The vehicle is owned, leased, or operated on a regular basis by a resident of the enumerated streets or parts of streets constituting the applicable resident-only parking area as set forth in Subsection E; and
(2) 
The vehicle has displayed on its left rear window in such a manner as to be visible a valid residential parking permit assigned to the vehicle; or
(3) 
The vehicle is an emergency vehicle, a public service, telephone company, or other public utility vehicle, a contractor, service, or delivery vehicle, and said exempted vehicle is present only during the time as services or repairs are being rendered within the area.
(4) 
Residents of an area designated in Subsection E may contact the Hackensack Police Department through its nonemergency number, (201) 646-7777, to request advance permission for a guest of the resident to park a vehicle in a residents-only on-street parking area for the sole purpose of visiting the resident in his or her home. The Police Department shall ordinarily grant such a request unless it determines that traffic and parking conditions at the time of the request render it impractical to do so.

B. 
Application for parking permits under this section shall be made in writing to the Police Department on forms provided for that purpose. Permits shall be granted only under the following terms and conditions:

(1) 
The applicant must be a bona fide resident within the enumerated streets or parts of streets constituting the applicable resident-only parking area as set forth in Subsection E. The applicant must provide appropriate documentation of such residency such as a deed or lease or utility bill or other verifiable information at the time of the application. The applicant’s New Jersey driver’s license and vehicle registration must match the address for which the residents-only on street parking permit is sought, except for permits issued to college students as set forth in Subsection B(4), below.

(2) 
The applicant shall submit either as proof of his or her ownership of the vehicle a copy of the lease agreement pertaining to his or her possession or such other verifiable information establishing that the vehicle is used by the resident on a regular and continuing basis. Except for permits issued to college students as set forth in Subsection B(4), below, the vehicle shall be registered in the state of New Jersey.

(3) 
No more than one vehicle per licensed driver shall be issued a permit.

(4) 
Resident parking permit for college students.
(a) 
Students attending an institution of higher learning located within the City of Hackensack but who are not permanent City residents, upon payment of the fee set forth in Subsection B(3) above, may be issued a resident parking permit. In order to be eligible for such a permit, the applicant must reside within the City of Hackensack during the academic year within the area where the resident-only parking program is in effect. The applicant must provide all of the following documentation to qualify:
[1] 
A lease agreement with the student's name listed as a tenant for the academic year in which the application is submitted;
[2] 
Proof of enrollment and attendance at an institution of higher learning located within the City for the academic year in which the application is submitted;
[3] 
Proof of vehicle ownership or usage as set forth in Subsection B(2) above, along with the applicant's driver's license and the vehicle registration;
[4] 
The student's valid e-mail address from the institution of higher learning, unless none has been issued.
(b) 
This resident parking permit shall expire 30 days after the student graduates from the institution of higher learning, or is no longer enrolled as an active student, unless he or she has become a bona fide resident of Hackensack within the area where the resident-only parking program is in effect. From time to time the City may require the student to resubmit any or all of the foregoing documentation and may revoke the resident parking permit of any student who fails to provide such information within 30 days after receiving such request.
C. 
No person shall:
(1) 
Copy, reproduce or otherwise create a resident parking permit.
(2) 
Create a facsimile or counterfeit resident parking permit.
(3) 
Display or use a resident parking permit or knowing the same to have been copied, reproduced or otherwise created in violation of Subsection C hereof.
(4) 
Furnish false information or fraudulent documents in connection with an application for a resident parking permit.
(5) 
Transfer a resident parking permit identification decal from a vehicle identified in the application to another vehicle.
D. 
The issuance of a resident parking permit shall not exempt a resident from obeying all other traffic and parking rules, regulations, ordinances and laws in affect in the area.
E. 
The following streets and parts of streets are designated as resident only parking areas during the hours indicated;

No vehicle which does not properly display a valid resident-only parking permit shall be permitted to park on the following streets between the hours of 2:00 a.m. and 6:00 a.m.

Resident-only parking permits shall be provided for the residents residing on the eastbound side (south side) of Essex Street from South Summit Avenue to Polifly Road to allow these residents to park on the streets regulated by the resident parking program. (This amendment to the chapter shall not be construed to allow parking on Essex Street at any time.)

Resident-only parking permits shall be provided for the residents residing on Anderson Street between Main Street and Linden Street, 5 Pangborn Place, Union Street between Passaic Street and Anderson Street and Park Street between Anderson Street and Passaic Street to allow these residents to park on the streets regulated by the resident parking program.

(10) 
Certain parking spaces in the Hackensack University Medical Center Parking Garage, located on Atlantic Street between Prospect Avenue and Second Street, shall be designated as twenty-four-hours-per-day, seven-days-per-week resident-only spaces. The spaces can be accessed via the westernmost entrance. These spaces shall be available only to residents of the buildings located between and including 2-4 Prospect Avenue and 64 Prospect Avenue who have obtained a valid parking permit pursuant to the procedure described in Subsection B. The cost for the permit shall be $35 per month, payable before the first day of every month. The permits required for the twenty-four-hour resident-only spaces herein created shall be different than, and distinguishable from, the permits required for the metered spaces available pursuant to Subsection E(11). The permits issued to residents to park in the twenty-four-hour-per-day spaces are not valid for use in the separate metered spaces.

Resident-only parking shall be provided at all metered spaces in the Hackensack University Medical Center Parking Garage, located on Atlantic Street between Prospect Avenue and Second Street, between the hours of 6:00 p.m. and 8:00 a.m. The use of these metered spaces shall be available only to residents of the buildings located between and including 2-4 Prospect Avenue and 64 Prospect Avenue who have obtained a valid parking permit pursuant to the procedure described in Subsection B. The permits required for the metered, resident-only spaces herein created shall be different than, and distinguishable from, the permits required for the twenty-four-hour spaces available pursuant to Subsection E(10). The permits issued to residents to park in the metered spaces are not valid for use in the separate twenty-four-hour-per-day spaces.

[1]Resident-only parking permits shall be provided for the residents residing on the westbound side (north side) of Essex Street at the following specific addresses: 424, 426, 440, 450, 486, 490, 500 and 520 Essex Street, which shall authorize these residents to park on the streets regulated by the resident parking program that are enumerated in § 170-71E(1). The foregoing shall not be construed to allow parking on Essex Street at any time.

Any violation of the provisions of this section shall be punishable in accordance with the provisions of Chapter 1, § 1-15, of the Code of the City of Hackensack, New Jersey.
