Terms used in this article shall have the meanings ascribed to them in Title 39 of the New Jersey Statutes Annotated.
A. 
In accordance with provisions of N.J.S.A. 40:48-2.46 relating to parking facilities open to the public or to which the public is invited, those parking spaces enumerated in Schedule A to this article[1] are hereby set aside and reserved for the vehicles of handicapped persons.

B. 
In accordance with the provisions of N.J.S.A. 39:5A-1, an owner of private property may request that certain parking spaces be set aside and reserved for the vehicles of handicapped persons, and in the event that such a request is approved by an amendment or supplement to this article, then the provisions of this article, including the penalties for violations, shall apply to such parking spaces.[2]

A. 
Each parking space set aside and reserved for the vehicles of handicapped persons pursuant to this article shall be marked with the required New Jersey designation sign (MUTCD R7-8) and the required penalty sign.
B. 
The owners of properties to which the public is invited shall be responsible for erecting and maintaining the required signs.
No person shall park a motor vehicle in any parking space which is duly designated and marked in accordance with the provisions of this article as being set aside and reserved for the vehicles of handicapped persons unless:
A. 
The vehicle shall have affixed thereto special license plates bearing the national wheelchair symbol, or the vehicle shall display a handicapped placard issued by the Director of the Division of Motor Vehicles or a currently valid temporary handicapped placard issued by a Municipal Chief of Police; and
B. 
A handicapped person is either the driver or a passenger in the vehicle.

Any person parking a motor vehicle in a parking space set aside and reserved for the vehicles of handicapped persons in violation of the provisions of § 250-25 of this article shall be liable to a fine of $276 for the first offense and, for subsequent offenses, a fine of at least $276 and up to 90 days' community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.
