A. 
The code promulgated by the New Jersey Department of Health and Senior Services regulating Public Recreational Bathing (N.J.A.C. 8:26-1.1 et seq.) and controlling the location and construction, alteration and operation of public recreational bathing sites and fixing penalties for violations is hereby adopted pursuant to N.J.S.A. 26:3-69.1 to 26:3-69.6. A copy of said code annexed hereto and made a part hereof without inclusion of the text thereof herein.
B. 
One copy of said code has been placed on file in the office of the Secretary of this Board of Health upon the introduction of this chapter and will remain on file in said office for the use and examination by the public.
There is hereby established the following schedule of fees for permits and licenses which shall be in addition to any other such fees established by the Township of Harding or the State of New Jersey:
A. 
Every public recreational bathing shall, on or before May 1 of each year, pay to the Harding Township Board of Health an annual license fee per facility in the amount set forth in Chapter 171, Fees.
B. 
Prior to the construction of a public recreational bathing facility, the owner or applicant shall submit an application and plan of construction to the Harding Township Health Department and pay to the Harding Township Board of Health a permit fee for plan review in the amount set forth in Chapter 171, Fees.
C. 
Prior to the alteration of a public recreational bathing facility, the owner or applicant shall submit an application and plan of alteration to the Harding Township Health Department and pay to the Harding Township Board of Health a permit fee for plan review in the amount set forth in Chapter 171, Fees.
A. 
Any person or persons, firm or corporation violating any of the provisions of this chapter or the Public Recreational Bathing Code made a part hereof shall, upon conviction thereof, pay a penalty of not less than $50 nor more than $1,000 for each violation.
B. 
Each day a particular violation continues shall constitute a separate offense.
The fees and charges hereinabove set forth shall not apply to pools, spas or whirlpools owned and operated exclusively by organizations or institutions which are exclusively charitable, religious, educational or municipal.
This chapter and the code herein established shall take effect 30 days after the first publication of the ordinance, in accordance with the provisions of Chapter 188, P.L. 1950 (N.J.S.A. 26:3-69.1 to 26:3-69.6).
