There is hereby established in the Borough of
Kinnelon a Road Department, which shall consist of a Foreman, Assistant
Foreman and department employees of various grades as the Borough
Council may hereafter deem proper and by resolution designate.
The officers and members of the Road Department
shall be appointed and designated by the Borough Council and shall
receive such salary as the Borough Council may determine.

Each member shall be of good moral character,
sound in body and in good health, and able to speak and understand
the English language.

No person shall be appointed an officer or member
of the Road Department who has been convicted of a crime involving
moral turpitude or who is less than 18 years of age. Nothing herein
contained shall be construed to prohibit the continuance in office
or employment of any person who is employed by the Borough of Kinnelon
in the capacity of a member of the Road Department at the time of
the adoption of this chapter.
The members of the Road Department shall hold
their office and employment during good behavior and efficiency, and
no person shall be removed from office except for just cause.
There may also be appointed such number of individuals
for a probationary period that the Mayor and Council may, from time
to time, determine. Such appointees shall, during their employment,
have the same duties and powers as members of the Road Department
of the Borough of Kinnelon. During the probationary period, the individual
under probation shall receive such training as specified by the Foreman
and the Road Department. No appointment of an individual shall be
made to the Road Department until a six-month probationary period
has been served.
The Foreman of the Road Department shall be
empowered to hire such additional temporary help and equipment as
is necessary in order to meet the seasonal or temporary requirements.
The Road Department shall be responsible for
the proper maintenance of all Borough-owned roads and rights-of-way,
the maintenance and care of all buildings and grounds owned by the
Borough, the maintenance and repair of Borough-owned equipment and
machinery, and any other functions as required by the Road Committee
of the Council.
The Borough Council may prescribe and establish
such rules and regulations respecting the Department and make provisions
for the acquisition of such apparatus, equipment and vehicles as it
may deem necessary or useful for the Road Department.

The administrative officers of the Department of Public Works,
namely, the Superintendent, the Foreman and the Working Foreman, shall
receive the same health and life benefits as set forth in the collective
bargaining agreement for the rank and file.
