It is the decision of the Commissioners of the
Borough of Longport that the use and operation of boats on the beaches
of Longport should be limited and controlled in order to protect the
safety, health and well-being of all citizens using said beaches.
The following definitions shall apply to this
article:
BOAT
A vessel or watercraft capable of being used as a means of
transportation on water and propelled wholly by sails or muscular
power. Specifically excluded from use upon the beaches are boats or
power vessels temporarily or permanently equipped with machinery for
propulsion.
OPERATE
To navigate or otherwise use a boat.
OWNER
A person other than a lienholder having the property interest
in or title to a boat. The term includes a person entitled to the
use or possession of the boat.
All rubber or canvas types of crafts and surfboards
are exempted from this article insomuch as they are regulated by the
Borough of Longport beach patrol regulations. Exempted craft may not be stored on the beach or street
ends.
Every owner of every boat, as defined above,
shall be required to obtain a license from the Borough of Longport
before bringing or permitting to be brought or using any boat as herein
defined on any beach or in the surf in the Borough of Longport.
All boat licenses shall be issued by the Borough
Clerk of the Borough of Longport. There shall be no more than 10 licenses
issued. Licenses shall be for a term of one year, from May 1 to May
1.
The boat owner's license fee hereunder shall
be in the sum of $50 and shall be payable in advance.
No person shall operate or allow any person
to operate any boat in a reckless or negligent manner so as to endanger
the life, limb or property of any person or in violation of the rules
and regulations of the Borough of Longport. The Captain of the Longport
Beach Patrol will designate on which beaches boats may be stored,
launched and operated during the period from May to November of any
year.
Lifeboats owned by the Borough of Longport and
used by the Borough lifeguards on the beaches are specifically exempted
from this article.
Violation of any provision of this article shall
make the party guilty thereof liable to a penalty of imprisonment
not to exceed 90 days or a fine not to exceed $500, or both. In addition
to the aforementioned provisions, the Board of Commissioners may suspend
or revoke the license in disciplinary proceedings. Said disciplinary
proceedings are started by a three-day written notice served upon
the licensee personally or sent by certified mail.
