The following words and items used in this article
shall have the following meanings:
COLLECTOR
Any person other than one having a contract with the Borough
of Bridgeport who collects or transports garbage, trash and/or refuse.
"Collector" shall include any person who hauls garbage, trash or refuse
to any site within the Borough, whether or not the same shall have
been treated, processed or compacted in any fashion whatsoever.
GARBAGE
Includes any accumulation of animal, vegetable or other matter
resulting from the preparation, decay and dealing in or storage of
meats, fish, fowl, fruits and vegetables, including tin cans, containers
or wrappers disposed of along with such material, but shall not include
rendering material.
PERSON
Any individual, firm, corporation, association or partnership.
REFUSE
Includes any waste product, solid or material having the
character of a solid rather than a liquid, composed wholly or partly
of such material as trash, rubbish, litter, industrial solid wastes
or domestic solid wastes from dwellings, apartments, markets, stores,
hotels, motels, restaurants, schools, churches, hospitals, colleges,
clubs and the like, but shall not include rendering material.
RENDERING MATERIAL
Includes clean edible fats and bones intended to be treated
by heat so as to separate the fats from animal tissue.
No person shall operate as a collector within
the Borough of Bridgeport without first having obtained a license
for the current calendar year from the Borough of Bridgeport Board
of Health. The license fee shall be as set forth in the schedule of
fees as adopted and amended from time to time by the Borough Council. One license will be required for each truck used by a
collector. Application for a license shall be made upon a form supplied
by the Borough. Licenses will be issued by the Board of Health of
the Borough of Bridgeport when the collector has complied with all
of the provisions of this article and paid the prescribed license
fee.
At the time he makes application for a license,
the collector shall produce:
A. A certificate of title for each truck for which application
for a license is made.
B. A motor vehicle registration for each truck.
C. A public liability insurance policy, for the year
for which application for a license is made, in amounts not less than
$30,000 for property damage and $50,000/$100,000 for injury to persons,
by an insurance company authorized to write such policies.
D. A standard workers' compensation insurance policy
by an insurance company authorized to write such policy.
E. A statement to be attached to the application, setting
forth the ultimate destination and disposition of the garbage, trash
and refuse collected or hauled to or from the Borough.
Licenses issued hereunder shall be personal
and not assignable; provided, however, that the Board of Health may
grant permission to a collector to change vehicles during the calendar
year without obtaining a new license. If a license or a licensed vehicle
is used by a person other than the licensee or an employee of the
licensee, or if a licensed vehicle is used for any purpose other than
that specified in the application, the license shall be revoked. The
Board of Health is authorized and directed to revoke a license for
any violation of the provisions of this article and may revoke all
licenses issued to a collector for a violation by any one of his trucks.
The following regulations and requirements shall
be applicable to all collectors:
A. Collectors shall not operate in the Borough of Bridgeport
before 7:00 a.m. or after 7:00 p.m. local time.
B. The Board of Health shall issue a license for each
licensed vehicle, which license shall be permanently affixed on the
inside of the left door of the cab of the vehicle. The name and address
of the collector shall also be painted on both sides of the truck
at least two inches high.
C. All vehicles licensed hereunder must be kept clean
and as free from odors as possible. Collections shall be made in such
a manner as not to create unnecessary noise or pollution of the air
or a nuisance adversely affecting the public health. Garbage and/or
refuse collected must not be spilled, dumped or thrown into any street
or sewer inlet or onto any vacant lot. In the event that a truck shall
break down, the Board of Health shall be immediately notified and
will give permission to transfer the garbage and/or refuse from one
vehicle to another, if necessary.
D. Collectors shall render reasonable and proper service
to their customers in the interest of public health.
E. Licensed vehicles shall be subject to inspection by
the Board of Health and shall be presented for inspection at the times
and places designated by the Board.
F. Collectors and their employees shall obey all applicable
Pennsylvania statutes, ordinances of the Borough of Bridgeport and
regulations of the Board of Health.
All vehicles used for collecting garbage and/or
refuse shall be:
A. Totally and permanently enclosed and of welded steel
construction.
B. Provided with a means of loading only at the top,
side or rear end, depending upon the design of the enclosed body.
C. So constructed that once garbage and/or refuse has
been loaded it cannot be reworked, sorted, handled or removed from
the body other than by dumping the load.
D. So constructed that no garbage and/or refuse can be
carried at any place on the vehicle other than in the enclosed body.
E. So equipped that all loading or unloading openings
on the body have adequate tightly fitted doors or covers with latches
or clamps to keep them closed and rubber or other suitable gaskets
to render them leakproof, spillproof and dustproof.
All collectors who furnish garbage and/or refuse
containers to their customers shall furnish and maintain all such
containers with operable lids which, when closed, shall effectively
prevent the escape of noxious odors, effluent, refuse and garbage
and which, when closed, shall effectively prevent the entry of vermin
and vectors into such containers. Furthermore, the name, address and
telephone number of the collector furnishing any such garbage and/or
refuse container shall be prominently displayed thereon.
Any person violating any of the provisions of
this article shall be subject to a fine or penalty not exceeding $300
for each and every violation, to be collected as like fines or penalties
are now by law collectible.
