For the purpose of this article, the terms used
herein are defined as follows:
The cold residue from combustion of any type of solid fuel,
such as wood, coal, coke, charcoal, paper and/or any similar substance.
CLASS IA single-family residence which is a dwelling occupied by one or more persons, the occupants of which live and eat together.
CLASS IIA two-family residence which is a dwelling housing two separate single families.
CLASS IIIA multifamily dwelling which is one or more buildings in the same building complex housing more than two families.
CLASS IVA business use which is a structure used entirely for commercial or business purposes or for commercial, business and residential purposes.
CLASS VAn industrial property which is premises devoted entirely to manufacturing or for any use other than residential or commercial, or property devoted partially to manufacturing jointly with any other use, except as provided in Class VI.
CLASS VISuch premises upon which there exists buildings primarily used for office purposes so long as within such buildings there are employed no more than 350 persons and so long as, in addition to the requirements contained throughout this article, the garbage and refuse to be collected therefrom shall be primarily dry paper products and contain no more than 1% food or other organic or wet waste material.
Any waste material in the process of or subject to decomposition or decay incident to ordinary domestic or business use or purpose, and shall include, among other things, kitchen refuse, animal or vegetable matter, any decaying and decomposing substance and/or dog feces deposited in accordance with § 124-4 of this Code.

Small tree branches capable of being broken by hand and hedge,
bush and vine trimmings; excluded are grass clippings, weeds, garden
plant and vegetable cuttings and leaves, the disposal of which is
governed by another ordinance.[2]

Household items only.
All noncoated papers sold or distributed at regular or irregular
intervals to convey or report news, opinions, advertisements or other
matters of public or private interest, but excluding all magazines,
books, periodicals, brochures, posters, cardboard boxes, containers
and other paper or paper products of any kind or nature whatsoever.
The owner, agent, tenant, lessee, caretaker or any other
person in charge of any premises affected by this article, whichever
classification may be appropriate and effective for its enforcement.
Any individual, partnership, corporation, firm, aggregation
or association of persons.
A person, firm or corporation duly licensed to render the
service of the collection of garbage or other refuse within the Borough
of Hasbrouck Heights for disposal elsewhere.
Enough receptacles for each premises to eliminate the need
for baskets, cartons, paper bags, etc.
A receptacle, as herein defined, having a closely fitted
cover or lid, so constructed as to prevent spillage or leakage of
its contents, having handles or other appurtenances thereto of such
type as to facilitate its emptying and which is maintained at all
times in a clean condition. Permitted as suitable shall be two types
of receptacles:
A Type 1 receptacle shall have a capacity of
no more than 32 gallons, shall have handles to enable it to be handled
by one man and shall be filled to a weight no greater than 40 pounds.
A Type 2 receptacle shall be one commonly known
as a "dumpster," having a capacity of no greater than two cubic yards,
and shall have standard appurtenant fixtures thereon to facilitate
dumping into standard garbage-compactor trucks.
All miscellaneous materials such as rags, paper products,
cardboard, cartons, leather goods, rubber, bottles, tin cans, broken
glass, crockery and/or any similar materials or substances, but shall
not include logs, earth, sand, bricks, mortar or other substances
which may accumulate from building operations.
The Division of Sanitation of the Public Works
Department of the Borough of Hasbrouck Heights shall be the enforcement
authority charged with the responsibility of enforcing the provisions
of this article.
No ashes, trash, rubbish, garden refuse, garbage
or newspapers shall be collected or disposed of except in accordance
with the provisions of this article.[1]

A.
Within the limitations hereinafter established, the
Borough of Hasbrouck Heights will provide two garbage collections
per week throughout the Borough in accordance herewith, except in
the event of an emergency which prevents collection. The day and approximate
hour of such collections in the various areas of the Borough will
be publicly announced and published. In case of any change in such
schedule, such modification will be made on at least one week's notice,
except in case of emergencies.
B.
As to Class I and II services, such garbage collection
shall be from rear yards or, in the event that the Superintendent
of Public Works determines that a particular rear yard is not reasonably
or practically accessible, from such other yard as he may designate
and, in either case, from Type 1 receptacles as herein defined and
as hereinafter regulated.

C.
As to Class III services, such garbage collection
shall be from such places as hereinafter designated and shall be limited
to one Type 1 container per living unit or the bulk equivalent in
Type 2 receptacles.
D.
As to Class IV, V and VI, only such services shall
be provided as may be authorized and directed by resolution of the
Mayor and Council hereinafter adopted. The operators of such properties
shall engage, at their own expense, the services of private, duly
licensed scavengers or collectors so as to provide collection of all
garbage from these premises with such frequency and in such manner
so that they are maintained in a safe and sanitary condition. Such
collection shall be in accordance with the standards set forth herein
and further in accordance with the regulations hereafter adopted by
resolution of the Mayor and Council. Such private scavengers or collectors
shall operate in the Borough of Hasbrouck Heights only between the
hours of 6:00 a.m. and 10:00 a.m., and all such operations shall be
only on weekdays, including Saturdays, and shall further operate only
in accordance with all other terms and conditions of this article
and in accordance with the rules and regulations which may be hereafter
adopted by resolution of the Mayor and Council.
A.
In general. All materials and substances to be collected
shall be sorted and held in receptacles as defined herein. Any ashes,
trash, rubbish, garden refuse and/or garbage of such nature or size
that it cannot be placed in a receptacle shall be properly and securely
tied into bundles or packages to prevent spilling or scattering. Such
bundles or packages shall be of a size to permit ease of handling
by one man and shall not, in any case, weigh more than 40 pounds when
full and shall not exceed three feet in length. All ashes shall be
cool to the touch and capable of being handled. Residents having household
items of a larger or heavier nature than permitted under this article
will place these items out only after first notifying the Sanitation
Department and on the date so advised by the Department. Newspapers
shall be separated and kept apart from other refuse for special collection,
as provided herein.
B.
Specific regulations.
(1)
The owner, agent, lessee, tenant and/or occupant of
every dwelling and other premises shall provide and keep on such premises
sufficient and suitable receptacles as specified herein for the receiving
and holding of the substances and/or materials referred to herein.
(2)
All receptacles shall be of metal or plastic sufficiently
strong for collection purposes and have a capacity of not more than
32 gallons or two cubic yards, as specified herein. They shall be
watertight and shall have a close-fitting metal or plastic cover.
Receptacles shall be located on the premises for convenient emptying
thereof and shall be maintained in such a manner as to prevent the
creation of a nuisance or a danger to health.
(3)
All receptacles shall be kept covered.
(4)
The occupant shall keep all receptacles clean and
in proper condition for safe handling.
(5)
After the receptacles are emptied by the personnel
of the Sanitation Department, they shall be returned to the point
from which they are taken by said personnel.
(6)
Plastic trash bags may be substituted for metal containers
for garden refuse, trash and rubbish, but specifically not for garbage,
all as defined herein. These bags must be securely tied and of sufficient
strength to allow being picked up without tearing or breaking. Such
plastic trash bags will be placed at the curbline by the householder
not earlier than sunset or 7:00 p.m., whichever occurs earlier, on
the day prior to the day fixed for collection.

(7)
All garbage shall be, as far as practically possible,
drained of all liquids, placed securely in paper or plastic bags and
placed in suitable receptacles.

(8)
Newspapers placed out by the householder for pickup
shall be securely tied or bound with bindings of sufficient strength
to permit the bundles to be lifted by the binding, the bundles to
weigh not more than 25 pounds each and not to exceed 12 inches in
height. All newspapers placed on the curb on the designated days in
accordance with this article shall be deemed the property of the Borough
of Hasbrouck Heights, and it shall be unlawful for any unauthorized
person or persons to remove, destroy or interfere with the same after
they have been so placed for collection.
(9)
Paper shall be securely and properly tied in bundles
or other packages in a manner to prevent any scattering while waiting
for or during collection. All pasteboard and corrugated boxes and
papers shall be collapsed and securely tied. The bundles or packages
shall be of a size and weight to permit handling by one man.
(10)
The Sanitation Department may affix a notice
to containers which do not qualify under the requirements of this
article indicating that the containers do not qualify and that further
use of said containers may result in confiscation of the containers
and/or refusal to make the collection as specified in this article.
If, at the next regularly scheduled collection date, said containers
still do not conform to the requirements of this article, the Sanitation
Department may collect the containers as specified and/or refuse to
make the collections as specified in this article.
(11)
In Class I and II services, no trash, heavy
trash or refuse, garden refuse, rubbish or newspapers, as defined
herein, shall be set out for collection on the curb in front of the
property earlier than the night before the collection day.
(12)
In all other classes of services, no articles
for collection, as provided herein, of any nature shall be placed
outside for collection before 5:00 a.m. or later than 9:00 a.m. on
the date of collection.
(13)
No article of any nature placed outside for
collection shall be placed in a way so as to obstruct pedestrian or
vehicular traffic upon either any street or any sidewalk.
C.
Heavy trash pickup. Heavy trash will be picked up according to the schedule as may be fixed for regular pickup under § 152-4 hereof. All self-locking appliances, cabinets or other containers, including but not limited to refrigerators and freezers, shall have removed therefrom such devices which cause contents therein to be locked before such appliances, cabinets or containers are placed for pickup.
D.
Collection schedule. Collection shall be on such days and at such times and hours as shall be designated by the Borough Clerk under § 152-4 hereof.
E.
Acts prohibited. It shall be unlawful for any person
to:
(1)
Place or store any of the substances and/or materials
referred to in this article in any paper bag, parcel, wooden keg or
barrel, basket, drum or any type of container whatsoever other than
the type of receptacle herein specified.
(2)
Co-mingle newspapers with other refuse, and any refuse
which contains newspapers, as herein defined, will be removed from
any property by Borough employees.
F.
Noncollectible items. The following refuse shall be
considered not acceptable for collection by the Sanitation Department:
(1)
Industrial waste materials or substances such as poisons, acids, caustics, animal feces except such deposited in accordance with § 124-4 of this Code, noxious chemicals, infected materials, explosives and ammunitions or any other materials likely to cause injury to persons employed or damage to equipment used in making collections.

(2)
Materials resulting from the demolition, repair, excavation
or construction of buildings or structures or such earth, plaster,
mortar, lumber or roofing materials.
(3)
Loose piles of vegetation or tree branches, unless
properly prepared for collection, as provided herein.
(4)
Materials which have not been prepared for collection
in accordance with the standards set forth in this article.
(5)
Materials which cannot be disposed of in accordance
with the standards and regulations prescribed by the Department of
Health and State of New Jersey for disposal of waste materials in
the sanitary landfill method.
G.
Nothing herein contained is intended to restrain any
resident or occupant from making alternate and private arrangements
for disposing of newspaper or to prevent charitable or other organizations,
authorized by residents or occupants, from collecting newspapers placed
on the curb for that purpose at other times than those days designated
for municipal collection.
The Mayor and Council may, by resolution, establish
additional rules and regulations covering the collections provided
herein. Said rules and regulations, upon promulgation, shall be posted
on the bulletin board maintained by the Borough of Hasbrouck Heights
and published in a newspaper acceptable for general legal advertisements
by the Borough of Hasbrouck Heights. The Mayor and Council shall have
specific authority to amend the provisions of the schedule of collections,
as provided herein, by resolution, to increase, decrease or change
the number of collections per week and the days of collection in any
zone.
Nothing herein contained shall prevent the municipality
from seeking injunctive relief to prevent violations of the provisions
of this article, and said remedies shall be considered to be in addition
to such other remedies as are specified in this article.
