The provisions of this article imposing a time
limit on parking shall not relieve any person of the duty to observe
other and more restrictive provisions prohibiting or limiting the
stopping, standing or parking of vehicles as set forth in N.J.S.A.
39:4-138, any other New Jersey statute or as hereinafter provided.
No person shall park a vehicle at any time upon
any of the streets or parts thereof described in Schedule I attached
to and made a part of this chapter.
A.
Restrictions generally. No person shall park a vehicle
between the hours specified in Schedule II of any day upon any of
the streets or parts of streets described in said Schedule II attached
to and made a part of this chapter.
B.
Overnight parking for trucks, buses and other vehicles
prohibited. It shall be unlawful for any person, firm or corporation
to park a truck, truck tractor, bus, motor-drawn vehicle, dump truck,
tractor, cement mixer, garbage truck, bulldozer or other like heavy
equipment used for road repair, excavation or construction work upon
any of the streets of the Borough of Totowa on any day between 1:00
a.m. and 6:00 a.m. Noncommercial trucks are excluded from the restrictions
set forth herein.

A.
No person shall stop or stand a vehicle at any time
upon any of the streets or parts of streets described in said Schedule
III attached to and made a part of this chapter.
B.
No person shall stop or stand a vehicle between the
hours specified in Schedule III of any day upon any of the streets
or parts of streets described in Schedule III attached to and made
a part of this chapter.
No person shall park a vehicle for longer than
the time limit shown in Schedule IV at any time between the hours
listed in said Schedule IV of any day upon any of the streets or parts
of streets described in Schedule IV attached to and made a part of
this chapter.
No person shall park a vehicle upon any of the
streets or parts thereof described in Schedule V attached to and made
a part of this chapter except at the angle designated and only within
the painted white stall lines.

Pursuant to the authority granted to this municipality
by N.J.S.A. 39:4-197, the locations described below are hereby designated
as restricted parking spaces for use by persons who have been issued
special vehicle identification cards by the Division of Motor Vehicles.
No other person shall be permitted to park in these spaces.
A.
Restricted parking zones may be established on public
streets in front of residential uses occupied by handicapped persons
in accordance with the procedures described herein.
B.
An application must be filed with the Borough Clerk
identifying the name and address of the handicapped individual and
the specific location of the proposed restricted parking zone.
C.
Upon application for a permit, the applicant must
provide the Borough Clerk with the following:
(1)
The license plate and proof of ownership of the vehicle
for which the permit is requested, indicating that the vehicle is
either owned by the handicapped person or by another occupant of the
residence who is a member of the immediate family.
(2)
A copy of the special vehicle identification card
received from the New Jersey Division of Motor Vehicles.
(3)
If the vehicle is driven by the handicapped individual,
proof that the said vehicle is equipped with such special attachments
and devices as deemed necessary by the Director of the Division of
Motor Vehicles to provide for the safe operation by the handicapped
individual.
D.
The Borough Clerk shall forward said application to
the Borough of Totowa Police Chief for a recommendation on whether
to approve or disapprove said permit. Said recommendation shall be
made within 21 calendar days of receiving such request from the Borough
Clerk.
E.
Upon receipt of an application to designate a restricted
parking zone for handicapped persons, the Police Chief shall perform
a site inspection to determine the following:
(1)
Whether off-street parking is presently available
on the property.
(2)
The location, width, grade and physical condition
of off-street parking and sidewalk connecting said parking to the
residence.
(3)
Whether parking is presently prohibited in front of
said residence.
(4)
Whether permitting the parking space would interfere
with the normal flow of traffic.
(5)
Whether there is a distance of 22 feet along the street
where a handicapped parking zone could be designated without interfering
with the normal flow of traffic.
(6)
Whether the handicapped person has reasonable access
to a driveway on the property or reasonable access to some other area
of the property which may permit transport of the handicapped person.
F.
Upon receipt of a favorable recommendation for approval,
the Borough Clerk shall forward the recommendation to the Borough
Council for adoption of an ordinance designating the handicapped zone.
H.
Upon adoption of an ordinance, the applicant shall
be required to deposit with the Borough Clerk the dollar amount necessary
to purchase the required sign. If the applicant changes the vehicle
to be permitted to park in the zone, the applicant shall pay an additional
charge necessary to cover the new sign required.
I.
The Borough shall install a sign at the designated
restricted parking zone. Said sign shall conform to the current Manual
on Uniform Traffic Control Devices and specifically identify the following:
J.
Only a vehicle with the license plate number shown
on the permit and sign shall be permitted to park in the restricted
handicapped parking zone.
K.
Any vehicle bearing a different license plate shall
be presumed to have parked unlawfully and shall be issued a ticket
and subject to a fine of $250, plus related costs, for the first offense,
and for subsequent offenses, a fine of at least $250 and up to 90
days' community service, or any combination thereof.
L.
All permits issued for the establishment of a restricted
handicapped parking zone shall be reviewed every year to determine
the continued eligibility of the parking zone.

Definitions. As used in this section, the following
terms shall have the meanings indicated:
The Borough of Totowa.
An area, not part of a driveway between two rows of parking
spaces.
Any strip of area between parking spaces or between parking
spaces and the boundaries of a parking area, not part of a driveway
or center island.
A space within a parking area maintained for the travel,
movement and distribution of vehicles to and from parking spaces.
The area between the curbline of a street and the property
line across which a vehicle may be operated in order to gain access
to a parking area.
The area between the curbline of a street and the property
line across which a vehicle may be operated in order to depart from
a parking area into a street.
Any area described in this section whereon parking of vehicles
is permitted, which is owned by the Borough of Totowa.
Any space within a parking area marked or otherwise designated
for parking a motor vehicle.
B.
Identification of lots. For the purpose of identification
in this section:
(1)
Union Boulevard and Jefferson Place shall mean and
include the area owned by the Borough, situated on the easterly side
of Union Boulevard and the southerly corner of Jefferson Place, known
as Lot 12, Block 31 as shown on the Official Tax Map of the Borough
of Totowa.
(2)
Union Boulevard and Masklee Court shall mean and include
the area owned by the Borough, situated on the westerly side of Union
Boulevard and the northerly corner of Masklee Court, known as a portion
of Lot 1, Block 95, as shown on the Official Tax Map of the Borough
of Totowa.
(3)
Veteran's Memorial Ballfield shall mean and include
the area owned by the Borough, situated on the southerly side of Totowa
Road, known as a portion of Block 119, Lot 2 as shown on the official
Tax Map of the Borough of Totowa.
(4)

Totowa Road shall mean and include the area owned by the Borough of
Totowa, situated on the northerly side of Totowa Road, known as Block
26, Lot 2, on the official Tax Map of the Borough of Totowa.

C.
General parking restrictions in municipal parking
lots. No operator or vehicle shall at any time within a municipal
parking lot stand or park a vehicle:
(1)
In any driveway.
(2)
On a crosswalk or walkway.
(3)
On a center island or dividing strip.
(4)
On any grass area or planted area.
(5)
In any entrance to or exit from any parking area.
(6)
In any space other than within a single space designated
for parking by pavement markings or otherwise.
(7)
In any manner other than headed into and facing a
center island, when occupying an interior parking space, or facing
the outside boundary of an area, when occupying an exterior parking
space.
(8)
In any manner so as to block or impede the progress
of any vehicle, or so as to prevent access by another vehicle to a
vacant parking space or exit from a parking space occupied by another
vehicle.
(9)
In any space or driveway where parking is prohibited
as indicated by a no-parking sign or any other marking or sign restricting
parking.
D.
Obedience to directions of police officers. Every
operator of a vehicle shall, when entering or leaving any parking
area subject to this section, or any parking space therein, or while
operating, standing or parking such vehicle within such parking area,
at all times obey any direction or signal given by a police officer
of the Borough.
E.
Use regulations for individual lots.
(1)
Union Boulevard and Jefferson Place.
(a)
Between the hours of 7:00 a.m. to 12:00 a.m.
Sunday through Thursday, parking shall be unrestricted, except that
no parking is permitted overnight between the hours of 12:00 a.m.
to 7:00 a.m.
(b)
Upon the declaration of an emergency by the
Mayor, or in his absence, the President of the Council, due to weather
conditions, accidents, fires, or public celebrations dictate or require
the avoidance of hazards or other conditions which interfere with
the free flow of traffic, parking may be permitted on an unrestricted
basis as well as overnight parking, subject to the posting of signs
declaring said emergency.
(2)
Union Boulevard and Masklee Court.
(a)
Between the hours of 7:00 a.m. to 12:00 a.m.
Sunday through Thursday, parking shall be unrestricted, except that
no parking is permitted overnight between the hours of 12:00 a.m.
to 7:00 a.m.
(b)
Upon the declaration of any emergency by the
Mayor, or in his absence, the President of the Council, due to weather
conditions, accidents, fires, or public celebration dictate or require
the avoidance of hazards or other conditions which interfere with
the free flow of traffic, parking may be permitted on an unrestricted
basis as well as overnight parking, subject to the posting of signs
declaring said emergency.
(3)
Veteran's Memorial Ballfield.
(a)
Between the hours of 7:00 a.m. to 12:00 a.m.,
Sunday through Saturday, parking shall be unrestricted except that
no parking is permitted overnight between the hours of 12:00 a.m.
to 7:00 a.m.
(b)
Upon the declaration of any emergency by the
Mayor, or in his absence, the President of the Council, due to weather
conditions, accidents, fires, or public celebration dictate or require
the avoidance of hazards or other conditions which interfere with
the free flow of traffic, parking may be permitted on an unrestricted
basis as well as overnight parking, subject to the posting of signs
declaring said emergency.
(4)
Totowa
Road and William Place.

(a)
Between the hours of 7:00 a.m. to 12:00 midnight, Sunday through
Thursday, parking shall be unrestricted, except that no parking is
permitted overnight between the hours of 12:00 midnight to 7:00 a.m.
(b)
Upon the declaration of an emergency by the Mayor, or in his
absence, the President of the Council, due to weather conditions,
accidents, fires or public celebrations dictate or require the avoidance
of hazards or other conditions which interfere with the free flow
of traffic, parking may be permitted in an unrestricted basis as well
as overnight parking subject to the posting of signs declaring said
emergency.
(5)
Veterans'
parking spot. One spot in each municipal lot shall be designated for
veterans' parking only.

F.
Unlawful overtime parking. It shall be unlawful and
an offense to permit a vehicle registered in his/her name to remain
parked in violation of the time restrictions herein. Each additional
and consecutive violation of the time restrictions herein in which
the vehicle remains parked in violation of the applicable time limit
shall constitute a separate and independent offense.
G.
Violations and penalties; removal of vehicles.
(1)
Any person who violates this section shall be subject
to the following fines and penalties:
(2)
In addition to the imposition of the above or any
other penalty which may be imposed by law for the violation of any
of the provisions of this section, the Borough may provide for the
removal of any vehicle which is allowed to stand or be parked in any
parking area subject to this section, where such standing or parking
is contrary to any of the provisions of this section; and the owner
shall pay the reasonable costs of the removal and storage which may
result from such removal before regaining possession of the vehicle.
