The following words, phrases and terms as used
in this chapter are hereby defined for the purpose thereof as follows:
CAMPER
A separate vehicle designed for human habitation which is
capable of being attached or detached from the body of a pickup truck.
CAMPER TRAILER
A vehicular, portable dwelling structure designed to be used
for recreational purposes. This includes but is not limited to a travel
trailer, a pickup camper, a folding tent trailer or a motorized camper
where the dwelling portion is an integral part of the self-propelled
vehicle.
MOTOR HOME
A self-contained vehicle designed for human habitation, with
its own mode of power and with a passageway from the body of the home
to the driver's seat.
RECREATIONAL VEHICLES
Includes boats, boat trailers, snowmobiles and snowmobile
trailers, wave runners, all terrain vehicles, as well as campers,
tent campers, motor homes, trailers and travel trailers.
TRAILER
A vehicle without mode of power, designed for carrying persons
or property on its own, but required to be drawn, pulled or towed
by another vehicle. Trailers shall also include but are not limited
to boat trailers, snowmobile trailers, all terrain vehicle and motorcycle
trailers, as well as utility trailers and construction trailers.
It shall be unlawful for any person to park
or store any recreational vehicle or trailer as defined in this chapter
on any property in the Borough of Totowa, except as follows:
A. The vehicle shall be parked in a side or rear yard
area of a residential property and is parked at least four feet from
the boundary line of any abutting residential lot.
B. Any recreational vehicle parked or stored in a side
or rear yard and not in an enclosed garage shall be screened from
view. Such screening shall not be less than six feet in height and
shall consist of either a trellis, latticework, basket-weave fencing,
stockade fencing, shrubbery or other similar material approved by
the Zoning Officer, except that, when such screening exceeds six feet
in height, the same shall consist only of shrubbery. Shrubbery shall
be of type and quantity to provide an immediate year-round screen
from the adjacent properties. Any fence shall have the least objectionable
side facing the adjacent property or the street. The width of the
screened area shall be limited to the width of the recreational vehicle
and an additional five feet. In no case shall screening exceed 16
feet in width and 40 feet in length.
C. Only one vehicle, inclusive of a supporting trailer,
may be stored or parked at any given time.
D. The vehicle may only be parked or stored in a rear
or side yard area of the owner's residential property.
E. Prohibited uses. The following uses are prohibited:
(1) No parked or stored recreational vehicle as defined
herein shall be occupied or used for human habitation, including but
not limited to sleeping, eating, resting or conducting business.
(2) No parked or stored recreational vehicle as defined
herein which does not carry a valid current year's license and/or
registration or which is in a state of external, visible disrepair
or partial construction shall be parked or stored in any zone; no
junk vehicles shall be permitted under this subsection.
(3) No major overhaul or bodywork shall be permitted on
any recreational vehicle when parked on the residential premises.
(4) No recreational vehicle shall have fixed connections
to electricity, water, gas or sanitary sewer facilities.
The use of trailers in any zone in connection
with site construction shall be permitted, subject to the following
restrictions and regulations:
A. Such trailers shall be located on the lot on which
construction is progressing and shall not be located within 25 feet
of the boundary line of any abutting residential lot.
B. Such trailers shall be used only as field offices
and storage, not for any dwelling use whatsoever.
Any person, firm or corporation who shall violate
any of the provisions of this chapter shall, upon conviction, be punished
by a fine not to exceed $1,250 for each offense or by imprisonment
for a term not to exceed 90 days, or a requirement of community service
not to exceed 90 days. A separate offense shall be deemed committed
on the day on which a violation occurs and each day the violation
continues to occur.
