It shall be unlawful for any individual, firm or corporation to keep, use, have, operate, maintain or install in the Borough of Totowa any gasoline tank or keep, use, have, operate, maintain or install any gasoline pump, pipe, hose or other apparatus within the Borough of Totowa without first having obtained a license from the Borough Clerk.
No permit for a gasoline station and/or tank shall be granted unless a written application duly verified shall be made to the Borough of Totowa accompanied by a statement and a map showing:
A. 
Premises. The size and location of the property for which the storage permit is requested.
B. 
Existing tanks. The location, type, size, capacity and material stored in all existing tanks.
C. 
Proposed tanks. The location, type, size, capacity and material to be stored in all proposed tanks.
D. 
Existing buildings. The location, size and use of all existing buildings on property involved.
E. 
Proposed buildings. The location, size and use of all proposed buildings.
F. 
Fire protection. Description and locations of fire-extinguishing systems to be installed and/or in compliance with the Fire Prevention Code.
The Borough Clerk is hereby authorized to issue any such license upon the authorization of the Council of the Borough of Totowa, which authorization shall be by resolution, following recommendation for the issuance of any such license by the Bureau of Fire Prevention.
A. 
The license fee under this chapter shall be, for each gas pump and for each grade of gasoline, the sum of $12 per gas pump and an additional fee for each grade of gasoline being pumped for one year, with said license to expire on June 30 of each year,

B. 
Under the provisions of this chapter, each outlet hose on a gas pump and each grade of gasoline on a gas pump shall be considered a separate pump and shall require the securing of a separate license and the payment of a separate fee.

C. 
The license fee herein provided for is imposed for revenue purposes.

No license for gasoline stations and/or gasoline tanks shall be issued under any of the following circumstances:
A. 
The storage either aboveground or underground of any gasoline in any residential area or in or on a lot upon which there is a residence or a single or multiple unit or units.
B. 
Where the applicant is situated within 50 feet of the nearest line of any premises occupied as a school, church, place of public amusement and/or public assembly.
C. 
The storage either aboveground or underground of any gasoline tank in any business district classified as B-2 and/or B-3 with the exception of existing gas stations presently located in said districts.[1]

Every such license shall remain in force and be valid only for the time therein expressed and shall apply only to the person or persons, corporation or corporations to whom granted and shall not be transferable.
Any person to whom such license is granted as herein provided is hereby requested to exhibit such license whenever called upon so to do.
No tank shall be put into use after its construction until inspection has been made by the Bureau of Fire Prevention and it is satisfied that all required conditions designated herein and supplemented by the Uniform Construction Code have been met.
