The purpose of this article is to establish
standards of conduct and the regulation of certain activities in and
about the public places of the Borough of Totowa and to fix penalties
for the violation thereof in accordance with the authority contained
in N.J.S.A. 40:61-1 et seq. and N.J.S.A. 40:48-2.
As used in this article, the following terms
shall have the meanings indicated:
PUBLIC PLACE
Any building, park, playground, athletic field, swimming
pool and picnic area owned or under the control of the Borough
of Totowa.
All public places shall be closed to the public
between the hours of 11:00 p.m. and 7:00 a.m. daily. No person or
group of persons shall enter or remain in any of said public places
between the hours specified herein unless specifically authorized
by the Borough of Totowa.
The following conduct in or about public places
shall be prohibited unless specifically authorized by the Mayor and
Council:
A. Sales or displays of or offers to sell goods or wares.
B. Betting, gambling and gaming.
C. Possession or consumption of alcoholic beverages.
D. Operation of all motor vehicles or motorcycles on
public places, except on driveways or parking areas provided for motor
vehicles.
E. No minibikes or other unlicensed motor vehicle shall
be permitted in any public place.
The following conduct in or about public places
shall be prohibited:
A. Cutting, injuring, defacing, removing, disturbing,
marking or writing upon any tree, shrub, building, fence, bench, sign,
monument, memorial or other structure, apparatus or property; lounging,
idling, sitting or lying on any monument or memorial; picking, cutting,
removing any shrub, brush, bush, plant or flower.
B. Uttering of abusive, indecent or profane language.
C. Fighting or other conduct disruptive of public peace.
E. Interference with or failure to obey any police officer
or parks or playground personnel in the performance of his or their
duties.
F. Permitting, suffering or allowing a dog to walk or
run, whether on leash or otherwise, in any public place except on
walkways, driveways or parking areas, and no person shall permit,
suffer or allow such dog to do any damage to any shrub, tree or other
property, nor to defile, soil or commit any nuisance upon any property
or public place.
The provisions of this article are in addition
to and not in repeal of, except where inconsistent herewith, otherwise
applicable requirements, prohibitions and provisions of law and the
ordinances of the Borough of Totowa in such case made and provided.

No person in the Borough of Totowa shall resist
any police officer or any person duly empowered with police authority
while in the discharge or apparent discharge of his duty or shall
in any way knowingly hinder, obstruct or interfere with him in the
discharge of his duty.
No person in the Borough of Totowa shall offer
or endeavor to assist any person in the custody of a police officer,
a member of the police force or a person duly empowered with police
authority to escape or attempt to escape from such custody.
No person other than a police officer of the
Borough shall wear or carry the uniform, apparel, badge, identification
card or any other insignia of office like or similar to, or a colorable
imitation of, that adopted and worn or carried by the police officers
of the Borough of Totowa.
No person in the Borough shall knowingly resist,
hinder, obstruct or interfere with any officer or person authorized
by law in serving or attempting to serve any summons, writ, subpoena,
order or any other process or when making an arrest.
