As used in this chapter, the following definitions
shall apply:
CONVICTED OFFENDER
Any person who has been convicted of a violation of the following
statutes: N.J.S.A. 2C:14-2, 2C:14-3, 2C:14-4 and 2C:24-4, where the
victim of said crime was a person under the age of 18.
PERMANENT RESIDENT
Any person who resides within the Borough of Totowa for more
than 30 days in any one year.
The Chief of Police shall maintain a registry of convicted offenders containing the information required in §
325-2 of this chapter in alphabetical order by street name, which registry shall be deemed a public record, and shall be available at all times for inspection by any person. A copy of the registry shall also be forwarded by the Totowa Borough Chief of Police to the Totowa Board of Education and the Passaic Valley Board of Education.

A. No person over the age of 18 who has been convicted
of a violation of any crime against a minor as listed in N.J.S.A.
2C:7-2, and who as a result of said conviction is required to register
with the proper authorities pursuant to N.J.S.A. 2C:7-1 et seq., Registration
and Notification of Release of Certain Offenders, shall be permitted
to reside or live within 2,500 feet of any school, park, playground,
day-care center or Board of Education approved bus stop in the Borough.
B. A person who resides or lives within 2,500 feet of
any school, park, playground, day-care center or Board of Education
approved bus stop in the Borough shall have 60 days from receipt of
written notice of the prohibition set forth herein to move. Failure
to move to a location which is in compliance with this section within
that time period shall constitute a violation of this section.
C. This section shall not apply to a person who has established
a residence prior to September 1, 2005.

Any person who violates any of the provisions
of this chapter, shall upon conviction, be punished by a fine not
to exceed $2,000 for each offense or by imprisonment for a term not
to exceed 90 days, or a requirement of community service not to exceed
90 days. A separate offense shall be deemed committed on the day on
which a violation occurs and each day the violation continues to occur.
