No rabbits shall be kept within the Borough
of Totowa without a permit granted by the Board of Health, which permit
may be revoked at the will of said Board upon proof of violation of
any section of this article or upon proof of violation of any health
laws of the State of New Jersey or ordinances or regulations of the
Board of Health of the Borough of Totowa concerning the health of
the Borough of Totowa. Each permit shall expire on December 31 in
each year.
No rabbits owned by a resident of the Borough
of Totowa shall be allowed to run at large in the Borough but shall
be confined in a suitable building or buildings; and if a runway is
provided the runway shall be enclosed; and such building and buildings,
commonly called "hutches" or "coops," and runway shall be kept in
a clean and sanitary condition subject at all times to inspection
by inspectors of the Board of Health.
No rabbits shall be permitted to be kept in
any part of a building or buildings used for residential purposes.
No part of any building or buildings, commonly
called "hutches" or "coops," used to house rabbits shall be less than
200 feet from any dwelling house, and, if there is a runway, then
no part of such runway shall be less than 200 feet from any dwelling
house.

No person shall have or keep in his possession
any pigs, goats, sheep or swine within the limits of the Borough of
Totowa.

No person shall have or keep in his possession
any live chickens, pigeons or other fowl without first having obtained
a license from the Board of Health.
Such license shall not be transferable and shall
continue to be in force and effect until the first day of January
next ensuing the date of granting thereof.

A license fee of $15 per pigeon loft and a license
fee of $1 a year per chicken or other fowl is hereby established.
Said fee shall accompany the application for a license.

The following rules and regulations shall govern
the keeping of live chickens, pigeons or other fowl:
A. No person shall keep or permit to be kept in any dwelling
house, store or building occupied by human beings, any live chickens,
pigeons or other fowl for breeding or raising, nor shall such fowl
be permitted to run or fly at large within the Borough of Totowa,
except that pedigreed homing, high-flying or air-performing pigeons
may be permitted to fly for exercise or training by the owner unless
such flight shall prove to be a public nuisance.
B. The construction, location and maintenance of sheds,
coops, pens and other structures in which fowl are kept or housed
shall comply with the following requirements:
(1) No structure shall be built or maintained which is
less than 25 feet from the door or windows of any neighboring dwelling
or less than 10 feet from any neighboring property line.
(2) All such places shall be kept in good repair, shall
have a floor impervious to moisture, waterproof, free from rats and
vermin, properly lighted and ventilated and in a clean and sanitary
condition at all times.
(3) All plans for such structures and all structures intended
for the use of housing such animals or fowl shall be in accordance
with the Building Code of the Borough of Totowa.
(4) No run of any kind shall be permitted. A wire porch
attached to the structure in which fowl are to be kept may be permitted.
Such porch shall be at least one foot above the surrounding ground
and shall consist of one-inch mesh hardware cloth for the floor with
any convenient size wire for the sides and top and shall not extend
more than four feet from the house or coop.
C. No more than 10 fowl or chickens shall be kept by
any one applicant at any one location, except that persons engaged
in the breeding or raising of fowl for commercial purposes in the
business zone, as nonconforming uses, or in the industrial zone as
defined in the Zoning Ordinance of the Borough of Totowa, New Jersey, whose structures for keeping and housing animals or fowl
are located not less than 100 feet from any neighboring dwelling may,
at the discretion of the Sanitary Inspector of the Board of Health
of the Borough of Totowa, be permitted to keep more than five animals
or 25 fowl. No greater number of animals or fowl shall be kept by
a licensee than shall be designated in the license.
D. All manure pending disposal shall be kept or stored
in tightly covered metal containers or in any other manner as approved
by the Board of Health, so as not to breed flies or create a nuisance.

Applications for licenses shall be made to the
Secretary of the Board of Health. Such application shall set forth
the name and address of the applicant and the location of the property
for which the license is sought and shall be accompanied by a rough
sketch of the premises showing structures already erected and to be
erected and a statement of the number of fowl to be kept. In the event
that structures are to be erected, satisfactory evidence that a building
permit has been issued for such structures must be submitted.
Anyone subject to the terms of this article
at the effective date thereof shall have a period of 30 days within
which to obtain the necessary license requested by the Board of Health
and pay the fees therefor. If he has not done so within such period,
the keeping of said animals shall be deemed a violation of this article.
